My question what would be what sheriff Joes hope for an outcome? Obama won the election and is the sitting US president even if a nutter found a smoking gun, so what. Having the world see that the US is so inept that it can not elected a president using their own rules is something no American should want even if they disagree with everything Obama has done. AS FDR pointed out the SCOTUS does do not have a military, so Sheriff Joe is wasting government resources to produce a report that can do nothing good. I can not stand most of things Obama has done but the birthers are acting like petulant children. November is when an argument about serving will be decided; the republicans just have to put up a person that is not bat sh*t crazy to win and that looks iffy at this point.

Joe should be brought up on charges of misuse of state government funds for wasting time and money on that.

It would be like the chairman of the Dallas ISD going off and spending time and money investigating whether the head of California's state board of Agriculture was adequately qualified to hold office.

Other evidences in support of "birther" claims include several faked foreign "birth certificates", a dishonestly truncated interview with President Obama's step-grandmother, legal "precedent" derived from Le droit des gens and not corroborated by any Constitutional provision nor federal statute nor court precedent and a misreading of Minor v. Happersett.

Accusations of racism, while accurate in isolated cases, should not be considered a general explanation of "birther" motives.

Many "birther" individuals have been convinced that the Democratic Party in general advocates institution of a fascist, socialist, Marxist regime where all religious worship is prohibited and radical Islam is established as the official state religion. Consequently, these individuals believe that any Democratic politician in any elected office is a threat to the United States of America, and are receptive to any claim that could potentially unseat a currently elected Democrat. Because the claim that President Obama not being a "natural-born" United States citizen would, if actually true, necessarily render him ineligible to hold office, individuals holding the aforementioned belief are receptive to such a claim. Their receptive attitude creates a confirmation bias: they will readily accept any "evidence" that will support the desirable (to them) position that a dangerous sitting President must be removed from office while they reject the substantial data that demonstrates such a claim to lack any actual basis in reality.

Some "birthers" are undeniably, by their own admission, racist, but many -- likely the majority -- are simply irrational and of low intelligence. All racists are irrational and stupid, but not all irrational and stupid individuals are racist.
