In other news, when applying for various types of licenses you agree to submit to random inspections.
Restaurant license to serve food? Unannounced health inspections.
Pilot's license? Random "ramp checks".
If this country had real penalties for first DUI (e.g. Year suspension and fine) maybe people would think twice so we wouldn't need checkpoints.

Banning checkpoints does not "protect your right to drive while drunk" anymore than banning telescreens in private homes "protects your right to beat your kids." Besides, umpteen studies have shown that if cops want to get drunks off the road, manning enforcement patrols -- cops who actually drive around LOOKING for drunk drivers -- is much more effective than casting blanket suspicion on every single driver who passes a given part of the street,

Traffic checkpoints are egregious attempts to circumvent the need for probable cause while hiding behind insincere pleas for public safety.
/but of course, they strengthen the law-abiding public's feelings of goodwill and trust in law enforcement

Subby if cops can't tell a drunk by watching them drive, then they are too dumb to be carrying a gun. DUI checkpoints are a direct violation of the 4th amendment. There is no reason, what so ever, to search everyone just because they are driving.

Compared to many other countries, it isn't.
Some will impound your car. Some will permanently ban you on the 2nd conviction.
The US does not take this seriously as we still have people on the roads after double-digit arrests.

if DUI checkpoints were about stoping people from DUI'ing then I'd probably be ok with them. But they're not because once you've been stopped at the checkpoint then anything the cop sees that suspicious is now probable cause for further investigation.
A few years ago my registration expired on my car because I was late coming up with the money to pay my property taxes on the car (you can't register without paying the taxes first.) I got stopped at a DUI checkpoint and my car ended up being towed.

If a cop at a DUI checkpoint asks for your "papers please," then he isn't conducting a DUI checkpoint and what he's doing is unconstitutional. A true DUI checkpoint checks for intoxication and nothing else. If there's no immediately observable indications of intoxication, you should be on your way. If not, you're being illegally detained.

And a third. People would be absolutely incensed if the cops marched into random homes and drug tested people, or set up a forensic kit and began scanning their home computers, "just to make sure" nobody's doing anything illegal.
BTW, the whole "but but but driving is a privilege not a right" argument is total crap, and it's increasingly being used to excuse virtually any sort of intrusive, obnoxious police-state crap that the state desires in order to
maintain order
increase revenues.
"Oh, flying is a privilege, so bend over!"
"We gotta protect the kids, so gimme your laptop for a search!"
"You're driving completely normally, so we need to stuff a camera/breathalyzer in your face to make our DUI quota for the month!"
"You're walking too near those kids on the playground, so we're gonna need to see proof you need to be in this public park!"
Bunch of nanny-state pussified garbage. Get a goddamn warrant or get out of my farking face.

The 4th Amendment, applicable to the states through the 14th, requires that a citizen only be subjected to a search and seizure, when there is a reason to suspect that person, individually, of committing a crime. Stopping everybody on the road with no individualized basis whatsoever is a violation of basic constitutional rights.

Not true. Me and a buddy were stopped at checkpoint a few counties from home one night about 10 years ago. We were stone-cold sober. The cops asked us to get out, interrogated us separately, and searched his truck. Our reason for driving across the state on rural routes in the middle of the night was pretty dumb, but we weren't breaking any laws. My buddy was going to see a girl (an amateur prizefighter) that he met on the internet. I was his wingman. the DUI checkpoint was a waste of our time. The whole trip was a waste of out time, really.

You could have just as easily been pulled over for the expired tags themselves. In your case, the checkpoint didn't really extended their powers at all.
That said, I agree with the sentiment of first paragraph.

Glad to see you in this thread, Twelve. Allow me to posit a question. What if I am at a checkpoint and invoke my right to remain silent, or refuse to roll down my window? Is refusing to speak to the officer an observable indication of intoxication?
