In other news, water is still wet, the earth continues to rotate about its axis, plants found converting CO2 to O2.

They may have a point. I saw one of those things recently and I'll be damned if they didn't just go right ahead and make that thing rectangular as it could be. Didn't even try to hide it.

I think Apple may have some merit. I mean, my old Nexus One took calls and sent text messages. I even was able to listen to music on it.

I think there should be a statute of limitations put on patents.

If a company infringes on another companys patents and they do not take action after it can be reasonably proven that they have been aware for 6 months or more, they should have no rights to take up a lawsuit on it.

Seriously, Apple knew that android used all of the features they are now suing for when it was introduced, they knew about it for years, only now when Android is drop kicking them in the mobile OS market nuts are they taking legal action. Thats total BS.

You file a patent on technology because you want to license who uses it and who does not, not so you can sue people down the road when they become a threat.

FTA: The fruity firm filed in California, saying that "a preliminary injunction regarding Samsung's new Galaxy Nexus, which infringes multiple key Apple patents, is essential to prevent immediate and irreparable harm to Apple".

OH NOES! Apple will only make $11B instead of $13B in the 3rd quarter of 2012 when it releases its iPhone 5!

And its $100B in cash reserves will only grow to $150B by the end of the year! THE HORROR! Won't someone think of the children of Apple executives and shareholders??

Apple is run by scumbags. Always has been, always will be.

People like to bash Microsoft for being evil, but they have NOTHING on Apple. Apple has a real streak of contempt for its customers, and for the rest of the technology world in general.

From the article:
"The fruity firm filed in California, saying that "a preliminary injunction regarding Samsung's new Galaxy Nexus, which infringes multiple key Apple patents, is essential to prevent immediate and irreparable harm to Apple"... Apple is fighting the Ice Cream Sandwich-loaded Nexus over four patents: predictive text; a data-tapper feature, which recognises data such as phone numbers and provides a link directly to the dialler, for example; a voice search feature that Apple believes is imitative of Siri; and the popular using-an-image-to-unlock feature."

I have an iJesusPhone 4, and both my parents have the Galaxy Nexus. Apple is full of shiat. Actually, Apple is making it more likely that I will not be getting another iJesusPhone in 2013 with all this bullshiat. iOS 5 was not revolutionary, it was lame. Android has more going for it WITHOUT rooting it, than the iJesusPhone does. Also, it's much easier to root an Android device than it is to jailbreak an iJesusPhone.

You might be right, but if memory serves, they have been suing for things like Slide to unlock, phsyical design, the speaker grill design etc... which is where my rant comes from. Face unlock can DIAF, its a novelty that nobody really cares about.

My issue with Apple AND Google is this constant patent battle. At this point it looks like they are playing Mutually Assured Destruction (insert War Games reference anyone?) And its BS. There needs to be SOME sanity to these patent laws.

It would be like me finding a garage band that used my name "Toast the Rabbit", feeling honored then suing them 10 years down the road when they had a hit record. I think I should lose the ability to dispute the use of my name after reasonably being aware of it for a certain length of time.

I don't think it's that Microsoft is less evil, it's that Apple is more overtly evil because, at the end of the day, nobody cares. Apple's executives know that they could make their products from sacrificed puppies and babies' tongues, make it a selling point, and the public would still gobble them up like Thin Mints. Why bother hiding what doesn't need to be hidden?

Of course they are. They're a company driven by Tim Cook, a man determined to fulfill Steve Jobs' dying wish of seeing the iPhone become a monopoly.

Again, it's time for Apple to be broken up. Hardware, software (iOS, OS X), and services (iTunes, App Store, etc.).

Please tell me where Apple behaved in a manner found illegal on two continents, where Apple used vapourware to put other companies out of business or indeed, more recently, where Apple front loaded the ISO standard committees to pass a standard half of which is "this is a binary blob and (C)" and never implemented it. I'll take bonus points for you pointing out where Apple have had a stated policy of Embrace, Extend, Extinguish.

Now if you want to take the stick out of your ass and have a sensible discussion on patent law reforms I'm all for it; however bouncing up and down about how Apple are far more evil than the beast of Redmond is just making you look retarded.

What's worse: a company that can be punished for its anticompetitive behavior, or one that can get away with it by abusing the patent system? I'd say the latter.

FTFA:

Apple is fighting the Ice Cream Sandwich-loaded Nexus over four patents: predictive text;

Um, don't all Android phones have predictive text? I start typing in a word on my HTC EVO and the software pops up with suggested words.

a data-tapper feature, which recognises data such as phone numbers and provides a link directly to the dialler

Um, again, my HTC EVO does this with my Facebook friends and their phone numbers listed in their info. It also does this if I go to google and do a search for a local business, and google lists their address (which I can click on and either use my GPS app will set the address as a location to drive to, or add the address to a contact), and their phone number (which I can click and have my phone call that number).

"a voice search feature that Apple believes is imitative of Siri"

My HTC EVO has a Siri-like app that pretty much imitates what Siri does. I like the speech-recognition/speech-to-text side of the app. I can text while driving without actually typing anything (hands-free texting)

and the popular using-an-image-to-unlock feature.

I never heard of this but I have a feeling that there is probably an App out there for the Android already that does this.

Seriously, Apple is grasping at straws now.

I'd say the former, one operated outside the law. The other is operating inside the law. We might not like the fact that those laws can be abused in this manner but as I said, I'm all for discussing how, exactly, we reform the patent system and applicable laws to put an end to this shiat once and for all.

The fact Apple is brining Siri in to the fight is however retarded, what? Nobody thought shoving Dragon Dictate in to a phone chassis and plugging it in to a various apps before? I'd swear my N95 had voice commands.

Even beyond that, browsers and other PC clients have been doing this with URLs for years. I don't see how matching \(?(\d{3})\)?-?(\d{3})-(\d{4}) is significantly more difficult than matching http:\/\/\S+

A bit tinfoil hatish for my tastes but some of these patents are absolutely ridiculous. The pogrom that Apple is on is just trying to hack away at the corners of Android by going after the vendors when it knows full well that a lot of the code is written by Google. In fact it is quite hipocritical of them in light of them coming to defense of small developers in the Lodsys lawsuits. Lodsys did exactly what Apple is doing now - namely going after the vendors for using a feature instead of the company that created and licensed the feature to the vendors.

Apple needs to man up and directly sue Google over Android for some $6 billion just like Oracle.

You can. Trademark law is different from patent law.

Additionally, patent law does have something similar, the laches doctrine. It means that, for example, a patent holder may not be able to get an injunction if they wait until the infringer gets really big. Instead, they may be limited only to reasonable damages.

Give it a rest. Apple's fun with patents was one of the major influences behind Microsoft's behavior in the 90's after Apple agreed to a license with Microsoft and then, after running into headwinds whilst Windows surged in popularity, tried to sue Microsoft into oblivion with a $4 Billion infringement claim. The fact that Google and Samsung reached similar commercial accommodations with Apple, supporting the launch of their own product lines, only to be sued by Apple once those lines become serious competitors shouldn't be a surprise. This pattern has already been played out by Apple and defending their behavior (through deflection as you are doing) of competition via litigation instead of innovation is sad.

2012-02-13 02:05:41 PM
You know, I'm still not sure why Apple likes to mess with Samsung so much. I mean, they manufacturer all the A5s that are the core of the new iPhone/iPad lines and the A4s that were the older versions... and the iPods... and the Apple TV.

Seems like they'd better off going after HTC or anyone else who didn't happen to have a stranglehold on their supply chain?
