I fail to see the big deal about this. If I was famous, I'd probably do the same thing in order to keep weirdos from marketing sex toys or crappy perfume using my child's name.

Not asinine at all. Somebody tried to trademark their child's name, and make money off it. Whether a surrogate was used or not, that is their child now, and their child's name should belong to them. NOBODY should be allowed to trademark another living person's name without that living person's permission.
Subby needs to stop sipping the Haterade for a moment, and give this one to Mr. and Mrs. Carter.

the mere fact of being famous shouldn't allow you to put an embargo on a trade-name.
They will need to have a product and a product class in order to lock the name up, additionally, they have to establish they are using the name in interstate commerce. They obviously will try to establish the Mark as being a 'famous' mark thus they can have broad protection, but without establish a produce and a market, that is going to be extremely hard to establish. As such, even if they are granted the mark, they are likely to lose any challenge to it.
As for using the name for a product, sure I can. I can name my product whatever I want as long as the name isn't being using in commerce at the time and within in my product class. Trademarks are not mandatory, rather they are protective for suppliers of good and services. It is important to remember that trademarks are not copyrights, they do not give protection to original authorship, instead trademarks are designed to protect the public, that is to say, that through trademark the public can be confident as to the source of the goods.
Finally, if I received a rejection based upon a famous baby, I would appeal and express I don't give two shiats about the famous baby, I am trying to trademark the name Blue Ivy for my trendy night club that's trade dress is the appearance of....wait for it.....blue ivy decorations all over walls, behind the bar, over door ways, etc.

Blue Ivy sounds like the name of a purfume. Specificaly the type little old ladies wear to much of.

Doing a search for Blue Ivy and subtracting "baby" and "Beyonce" resulted in a company, a flower shop, a clothing store, a type of geranium and other stuff.
Tried putting up a bunch of links, but it was puked back by FARK.

I would just like to note that their daughter is really quite beautiful.
That being said, her parents are being asshats and Blue is very likely going to be the next Paris Hilton.
She will not have her mother's class.
