5 day waiting period? It is a 3 minute call to the ATF after you fill out the 4473 and you are good to go.

I think some states have a mandatory waiting period before you can take possession even after you've passed the federal background check. /shrug

The "problem" is that private firearms transactions between individuals are somewhat unregulated. They don't want you to be able to buy a gun without getting the approval of the federal government.
They haven't been able to get any traction with yelling about the nonexistent 'gun show loophole', so now they are gonna try the 'internet loophole'.

I'm pretty sure there's no waiting period down here in Louisiana. Or background checks. Went to a gun show with a friend who still had a California drivers license. They could have sold him the gun right then and there, but had to abide by the laws of where ever his ID was from (Cali does have a waiting period and background checks.)
I didn't get all the details, because I didn't care. End result is he didn't get the gun, but could have if he changed is license back to LA.

For long guns? I'm not 100%, but I don't think so. Certainly not here in WA.

And seeing as how no newspaper (or Craigslist I think, don't know for sure as I haven't checked) will accept ads any longer for firearms, that 'loophole' has been closed.
My favorite parking lot story was a few years ago when the Boy Scout Troop that I was involved with bought 15+ .22 rifles from a Scout camp that was upgrading theirs (our Troop has it's own range). We worked out the details while we were at the camp that summer & then once the camp closed for the year we met halfway there in a Walmart parking lot to buy the rifles (beautiful Winchester & Remington WW2 trainers). Imagine if you will two relatively scruffy individuals (myself & the guy keeping me company) sitting in a van when another van pulls up next to them. After a quick round of handshakes from out of the other van rifle after rifle after rifle get handed out (uncased as they were keeping them for the new rifles & we hadn't bought ours yet) & loaded up into my van. Joking that we were probably putting on quite a show & that the police were likely to show up with the SWAT team at any moment, I looked over & a couple cars down was a mother who's eyes were getting bigger & bigger & she kept clutching her daughter closer & closer. Amazingly enough she didn't call the police (or they didn't bother to show up - not likely). I guess we looked like the area's normal rednecks rather than a herd of terrorists.

Nope, it's a federal thing. You can't travel out of state (with some exceptions, and I can't remember what they are) and buy a gun.

Maryland does for handguns. You can clean the rest of your firearms to pass the time. I never understood the point behind the waiting period for people that already own a handgun.

A select fire rifle chambered in an intermediate cartridge is the technical definition. Anything with black plastic furniture or a banana magazine is the media definition.
What 5 day waiting period? For an actual assault rife it's more like 3-6 months waiting on BAFTE. Otherwise there isn't one in most states.

So, someone with more knowledge than me please explain: is it legal for a private owner to sell any non-FFL-covered weapon to anyone without paperwork, ID, record of transfer?

I think perhaps the idiots at MSNBC and other media outlets need to have their backgrounds checked and a 10 federal business day wait before printing a paper, making a broadcast, or expressing an opinion.
If they wish to broadcast something particularly inflammatory or unpopular, they may do so after notifying the FCC of their intent but only if the FCC allows it. The FCC shall have 15 federal business days to respond with "approve", "denied" or "delayed". If the response is a delay, the broadcaster may make the broadcast but only after waiting an additional 15 federal business days unless the FCC issues a denial in that time period.
Also, for the commercial broadcasters, I think they need to keep a bound book paper record of everything broadcast (both words and pictures, each individual frame from video) for the FCC to inspect whenever they like without notice with no more than 364 days between each inspection. Should the broadcasters not want to do this, they must immediately contact the FCC and surrender their broadcast license and all equipment, and provide said bound book records to the FCC for permament archiving.

It depends on the state and the firearm. Some states allow it for long guns only, some allow it for long guns and hand guns. The sale, however, must be an intrastate sale...meaning that the sale must take place in your home state, and you can only sell to a resident of the same state.

It sounds like what they're trying to expose is straw purchasing (which are definitely illegal) whereby a person who is not legally prohibited from owning a gun will purchase one on behalf of someone else, likely because that person is prohibited from owning a gun for some reason. They try to make it sound as if this is common practice that legitimately licensed dealers engage in with full knowledge, but that's not the case. That exposes them to some serious federal ass-reaming, and they will lose their license to sell firearms if they're caught doing it, and that's something they take seriously.
Meanwhile, in my state of Florida, if I want to sell a gun to someone else, I can literally hand one to someone in a parking lot and its not illegal at all. No paperwork involved and I don't have to tell the government anything about it. :)

In Florida at least, it is completely legal for you as a private individual otherwise eligible to own and posses firearms to sell or buy any non NFA firearm to a likewise individual, no paperwork, no ID, no questions asked. Smart? no. Legal? yes.
I prefer and require a concealed weapon permit holder to sell to but will buy off anyone with a bill of sale and statement certifying the weapon has a clean history.

Great writing there, Lou. Seven paragraphs worth of "online gun sales" mentions, and tons of fear words like criminal, terrorists, and murder before we see what he's really talking about. PRIVATE online gun sales. Online gun sales from businesses require the same background checks, and the added step of going through a FFL in your area, since NO online gun store will ship a gun straight to you.

The law isn't structured like that. You're not allowed to be
in the business
of buying and selling firearms, so anything you sell has to come from your private collection and go to a private individual from your state. (Selling cross-state requires an FFL.) Whether or not your rapid sales of firearms to others constitutes a
business
rather than rapid turnover of a private collection would be something that prosecutors have to prove, and a jury will have to ultimately decide.

In CA, there is a 10 day waiting period. Any sales of guns must go through an FFL holder, who charge you $75 for the privilege if it's from out of state. And you can only buy one new gun per 30 days. That limits you to only 12 handguns per year.
