Wait.

So he didn't do anything with a 12 year old girl.
He didn't even try to meet up with the non-existent 12 year old girl.

So he got arrested for what basically amounts to thought crime?

What's that old saying - if there's blood in the pocket, feel free to rock it?

Or if the meat won't budge, time to pack the fudge?

Something like that, anyway.

Protip #2: All the sexy, flirty 12 year old girls that want to see your grown man junk online are undercover cops.

Protip #3: The rest of the 12 year old girls online are Homeland Security agents or have a father who is finally home from prison after a felony assault conviction with and are having a hard time adjusting to life out from behind bars.

Just don't go there.

You mean that 13 year old girl I was more than flirting with who invited me over to their home while her parents are away isn't real.

I already have the mike's hard lemonaid and condoms purchased.

/Sarcasm for those who don't get it easily.

I get that these perves need to be put away, but I still can't get my head around that they get busted for trying to have sex with a minor when no minor is actually involved.

Where is the ACTUAL crime?

If you could get paid to sit behind a computer and troll chatrooms for people of questionable morals and get paid for it without doing any actual work, wouldn't you? Especially if you didn't have a conscience?

The crime is the attempted solicitation of minors for sexual purposes. Sometimes you don't have to do a thing to get in trouble for trying to do it. This isn't exactly a controversial idea. If someone attacks you with a knife but you get out of the way and a nearby cop arrests them before they can hurt anyone... should they get in trouble? They didn't ACTUALLY hurt anyone, right? But letting them go would be ridiculous; they're clearly violent, and if they stabbed you or someone else later people would blame the cop for letting him go. I don't think it is necessarily any better of an idea to turn a blind eye to someone who actually tries to seduce someone they really believe is 12 years old.

Bottom line is, don't do, or try to do, stuff that you'd get thrown in the slammer for.
Simply because you failed to accomplish your misdeed doesn't mean that you're any less heinous of a person for trying.

His best defense is to claim that he KNEW it was actually his Frat brothers and not a kid. However after finding out that it was not his Frat brothers he would like to charge the offending officer with impersonating his Frat brothers and thus entrapping him by identity theft. There are known knowns and unknown knowns and then there are known unknowns. It clearly is one of the three.

I attended a computer crime investigations class once that turned out to be only about trolling for pervs. Useless for me in the private sector, but I learned some things. First of all, it takes work to convince a skeptical, careful pedo that you're really a young girl. You need to know the music preferences, current teen hearthrobs, slang, etc. of that generation, and answer testing questions on the fly. (Do you know offhand what size panties a 12-year-old wears?) (Don't answer that.)

As a class exercise, we went into a chat room labeled "dads and daughters". The fact that the guy on the other end was a perv, in and of itself, didn't creep me out as much as ... I find it difficult to even type it... cater to him, let's put it that way. [shudder]

My point is, it's not easy money. (Unless you're turned on by that sort of thing.) You couldn't pay me to do that again.

Probably why some cops snap and get themselves into trouble in that line of work.

If someone attacks YOU with a knife, a crime certainly was involved, even if you escaped unscathed. It's an assault, even if there was no actual contact. He caused you to fear for your life- that's a crime in most places. Try pointing a gun at a random person on the street as a joke- you'll still get arrested. A more apt analogy would be a john soliciting a prostitute that is actually a cop. But in that case, it's the solicitation in itself that is the crime.

Meanwhile, the actual 12 year olds are going elsewhere for sex with pedos. Where? No idea. But the cops will start hanging out there in about 10 years, pretending to be children, and then we'll know.

I understand what you are saying, I am merely intrigued by the fact that no one was in danger, the "minor" he is accused of "attempting to have sex with" does not exist, so again, I don't see a real crime, just the POTENTIAL for criminal behavior. Again, don't get me wrong, the dude needs to be put in prison, but as an intellectual exercise I find it fascinating. It's like being arrested by the thought police.

I know, I get hung up on the part about there being no minor at all. He was in reality attempting to get busy with a cop.

Your example isn't really the same thing; there is a real person that is the target of the attempted murder... If he was say setting plans, purchasing knives and garbage bags and the like to kill Bugs Bunny, would he still be tried for attempted murder?

Just an interesting question.

I honestly don't understand how these kinds of stings still work. These guys are using the Internet to hook up with their junior hos, you'd think they'd, I dunno, read other things on the Internet that helpfully point out any 12-year-old junior hos who want to hook up with you via chatrooms, etc. are actually undercover officers.

Or maybe they're eternally optimistic. "I've seen all these stories about guys getting busted by undercover officers posing as hot and horny 12-year-old girls... but this one seems legit!"

I see your point. If I fashioned a mannequin doll as an minor, and I were caught with it, or filmed over a period of time acting out lewdness toward it, could I be arrested?
That is clearly different from the other example about a genuine attempted knife assault against an actual person.
Yet some would argue that it is "the same" as an attempt against a real minor, because it shows "where my mind is" and therefore I should be locked up.
That's where the thought-police aspect comes in.

That's a great example.

It seems similar to doing an internet search for kiddy pr0n and clicking on a link run by the FBI masquerading as a kiddy pr0n site, with no actual images, and getting charged with possession (attempted possession?) of child pornography.

Interesting...

FTFA einstein:

The arrest followed a three-month investigation during which D'Amato allegedly engaged in inappropriate conversations with the officer and on several occasions exposed himself on a webcam, said Passaic County Sheriff Richard Berdnik.
