Something similar to this happened local to me last year. The man (black) was in diabetic shock in his condo and and a next door neighbors cleaning lady heard loud noises and caught a glimpse of him thought the window. She then called the police because she thought he was robbing the place, the police found him naked sitting on his upstairs toilet and thought it would be good to beat him with a night sick and pepper spray him for a bit when he was un-compliment

Inquisitive Inquisitor: Years ago I saw a traffic stop turn into a fracas when a man went into a seizure and started flailing around. The officer interpreted it as resisting arrest and did the bare minimum to subdue him. After EMS arrived and his condition was noted by the paramedics the officer immediately contacted his supervisor, removed himself from the scene and turned himself in for discipline. He even went to the hospital and apologized for what happened. There was no cover up and no one lied to save face.

That's how you own up to a mistake as a law enforcement officer.

No, that's how you get the shiat sued out of you by anyone involved for an insane amount. You cannot do this in a litigious society that we live in. It's also how you get to drop any legal and union protection you had as a police officer in the incident, since you've now gone around the chain of command and established policy and procedure of the department.

Chances are, he had someone with stars on their lapel telling him to go apologize.

Actually, studies have shown it's a way to PREVENT litigation. Note who gives the 'don't apologize' advice - LAWYERS. Why would lawyers tell you not to apologize? They know it actually increases the chances you'll be hauled into court and need their services.

There was a SWAT team that busted in the front door of the wrong house, a old lady lived there. The police sheriff came and personally apologized, said that it was a mistake and that procedures would be reviewed(not changed, reviewed). He posted a deputy to watch the door until the carpenter he hired came that morning to fix it.

Result: No lawsuit.

SWAT team does much the same in another county, says it was justified, refuses to pay for anything, etc...

Result: Lawsuit and ~$1M judgement

This sort of thing happens all the time--people think a diabetic who is having an episode is drunk. It's understandable but preventable.

There's also a tragic amount of ignorance an misinformation about mental illness, epilepsy, autism, disabilities, etc.

Educate yourself on the symptoms and treatment of common afflictions such as stroke, diabetes, epilepsy, shock, etc. It may save a life or a misunderstanding.

The light bulb is supplied with electrical current by feed-through terminals or wires embedded in the glass, while the officer is supplied with energy through the mechanical and chemical breakdown of food into smaller components that are more easily absorbed into the blood stream.

The LV PD clearly could use a brush up on understand different types of conditions that the citizens could have, this was misdiagnosed as intoxication so you cannot be too vigilant in getting someone in a moving vehicle off the road, kudos for LEO's on that call.

The force used was somewhat heavy handed however, given the context I think things could have been a lot worse. Cops are going to back each other up just like you guys do for your fellow burger flipper and AOL call centre biatch, no need to pretend like your really upset about something you are guilty of too.

You are correct, sir. Why, just the other day, I, and 4 of my co-workers jumped over the counter at Mickey-D's, and proceeded to kick the ever-lovin' shiat out of an old man who was complaining about his fries being cold.

I'm sure all of us are guilty of using excessive violence in the workplace from time to time. If the rest of us are free to commit violent criminal acts while on the job, why should the police be held to a different standard.

You already know the answer. If all cops were held to the same standard, which they shouldn't and I'm very glad they are not, we wouldn't have any cops left out there. They would all be behind bars.

I don't if it's jealousy or just lack of understanding of politics and basic human behaviour, but some of you have a real issue dealing with the fact that cops are above the law and are legally viewed as 'better people' than you and I. We all know this is the case and it's rammed down your throats on a daily basis.

Just deal with it.

All records have been sealed on the case, and the Hartford, VT police and VT state police stand behind that decision. Since he was not actually arrested so they don't need to release the records. in accordance with Vermont laws.

/end csb
// could the fact that he was black and this was VT have anything to do with it? mayybe

shiat happens.

Everyone of you has implicitly agreed to the system we live in, which is you pay to be protected. Law Enforcement agents put their lives on the line daily to protect us from a laundry list of ailments, situations and other people with less than good intentions.

The odd time a LEO will exercise poor judgement and unfortunate situations like your story will take place. Tough. We do not live in a perfect society and you all clamoured for a decade about being in fear from terrorists and needing to be protected from every little threat. The Federal Government got the memo, don't worry. But the key is you don't get to pick and choose what a free society where you are protected by the Government looks like, they do.

Cops are above the average grunt salary earner, they won't tell you that because you have the emotional intelligence of a 5-yr so they simply joke about it amongst themselves but look no farther than this incident itself where the DA is protecting the cops by hiding their names from the public.

Get it through your head, Cops are better and more valuable people than you are, and you'll be treated like such whether you like it or not. And no, you gave up your right to complain about it once you gave up your freedoms and liberties in exchange for 24/7, digitally recorded around the clock protection from the outside world. These cop bashing threads really make the lot of you look worse than you are, if that is ... possible, wow. You asked for this, and if it was as bad as you try and portray the system as, you'd get off your lazy fat ass and do something to change it.

You won't, and you'll remember to keep your yappy mouth shut as soon as it's in front of a Law Enforcement officer and away from your shield of stupid, the PC.

/Loves watching tough guys shrink down to their REAL size and piss their pants when confronted with true authority

Maybe we should start a campaign, get a Federal Grant, educate the SWINE and pocket millions in the process?

DRUNK OR DIABETIC, THERE IS NO EXCUSE TO KICK A NON-RESISTING MAN IN THE HEAD.

There's no excuse to kick anyone in the head. Resisting or not.

There was a push a few years back to make every law enforcement officer in the United States a certified First Responder. Although it was because of the AED and CPR, not because of the diabetic issue.

As I recall, it never gained steam because the LEO community was worried about the legal implications of assuming care of a patient.
