He asked the woman where she'd like to go to eat. It was her choice.
I bet that was awkward for a moment when the judge asked a married woman in open court if she'd like to go out to dinner.

And since when is choking out your wife a "mild incident"?

His sentencing is like a Disney movie fairytale in that there is the pomp (bowling) and circumstance (Red Lobster) leading up to . . . the part we get to imagine, meaning he didn't specify what type of sex was to follow, a bit odd given how prescriptive he was with everything else. For all we know lobster tails and bowling might get this guy into the mood for some nonconsensual BDSM. I wonder what the judge's recommendation will be then. Maybe he'll go over to their house and coach them through that too. "OK, good, good, insert the penis, yes . . . Choking? No, stop that. Put down the knife . . . OK, good now continue . . ."
/I'm not the one who made domestic violence a laughing matter; the judge did.

Being forced by the court to go on a romantic encounter with someone you nearly beat? This will solve their probems and likley end well.
Also, how does the judge have the authority to do this?

It's a bond hearing, the judge can set whatever terms and conditions for release that he wants. Just consider this as being sentenced to house arrest, only the house is a horrible restaurant and a bowling alley instead of a place you'd like to go to.

Nice try...but you can't order a person to "be" with someone they don't want to be with. I would have just said, "Listen Judge, obviously I don't wanna be with her, as i was about to beat the shiat out of her, so your cure for this, is to send me out to spend more time and my money on her. Hmmmm. Are you a idiot? I'll take the jail time. Thanks.

Reading from an arrest affidavit, Hurley said Bray pushed his wife onto their couch and put his hand on her neck. He held up his fist to hit her, but never struck her, Hurley said.
That isn't "near" physical abuse.
"It was a minor incident, in the court's opinion," he said.
Anyone does that to my daughter and I can assure you there will be a "major incident".

living in Plantation, FL where the new "Stand your Ground" law allows anyone who feels in fear of his life to use deadly force to protect themselves......
Any guy grabbing me by the throat and threatening to punch me with the other fist is gonna wind up with a "'cap in dey a**"
And if he turns around again, he will get a cap in the other cheek too.....Stupid Judge Hurley is known for his idiocy here.

"It was a minor incident, in the court's opinion," he said. "The court would not normally do that if the court felt there was some violence but this is very, very minor and the court felt that that was a better resolution than other alternatives."
Reading from an arrest affidavit, Hurley said Bray pushed his wife onto their couch and put his hand on her neck. He held up his fist to hit her, but never struck her, Hurley said.
Sounds fairly serious. He didn't hit her, but it wasn't exactly a tickle fight either

If the judge wants to be a social worker, I'm sure the county would be willing to accommodate him at an appropriate level of compensation.
Or perhaps he aspires to be a marriage counselor. If so, not on the public dime, bub.
Absent that, he needs to STFU and do his damned job... or go flip burgers if he's qualified.

If there was no violence, how is a charge of domestic

warranted? Or was there violence not involving hitting?

No, the technical reason is (from what I read in the article) not that this is "unusual", but rather that this is not "punishment." The defendant hasn't been sentenced to take the wife out on this first-class date, he's been told that the condition for his release is to take the wife out. Another comparison is to someone being told that they don't have to go to prison for DWI as long as they pass the breathalyzer attached to the car's ignition. But in this case, the DWI is domestic violence and the breathalyzer is heartburn, lung cancer from second-hand smoke, and some sort of fungus from rented clown shoes.

Good ruling.
-The husband, if he really hates her, can just stay in jail. Which honestly, he would deserve for thinking that beating her was a better alternative than simply leaving the relationship.
-Or if the husband doesn't want the relationship to end, he's got an easy bail (dinner and bowling). And then some marriage counseling which, based on the choking thing, sounds like *they* both need.
/guess even Florida will get one right on occasion.
