it was any kind of file and direct download link service that hosted the files, torrents the tracker does not host the file

torrents = file sharing phone book

it's not drug dealing. it's not terrorism. it's not money laundering. it's not illegal weapon sales....it's just data. little ones and zeros transmitted from one location to another. it's not even a criminal offense - at best its a civil case over copyright infringement.

And yet this guy got the treatment usually reserved for major weight drug deals and heavily armed terrorist compounds.

WTF man? really? don't defend this. it's horrific.

So.. am I going to be the one to point out that he waddled into his safe room while his wife and kids were being SWAT'd?

I mean, I'm on his side of the legal case, but cripes man. If it's kidnappers kicking in your door, what do you think they're going to do when they discover you locked away but your family lingering about in the less armor-plated areas of the house?

Well one of the charges against them is "conspiring to commit money laundering". Not sure how or if it will stick, but it is one of the charges.

Did they deserve this level of "justice"? No, but I don't feel too bad considering they were all morons. If you're gonna profit off of copyright infringement, don't keep actual records of it (i.e. the "I'll pay you for uploading copyrighted materials" e-mails).

When you have a SWAT team, you have to use them, otherwise why have a SWAT team? You just know there's a quota for using the SWAT team just like there's a quota for parking tickets. The commander looks at the calls for the month and says, hey, we haven't used the SWAT team yet this month. So they use them for the next warrant that comes in, whether it's called for or not.

Hey, its been 3 years since New Zealand needed to use their SWAT team. The guys were getting rusty and they needed to justify the SWAT budget anyway.

I was just making the distinction, torrenting is harder to prosecute since the actual torrent file and tracker are not hosting the files

hosting content and having ads on your site is just asking for it, you are profiting from it

If you read the guy's history it was one giant tale of fraud, lying to investors, and farking around with stock prices. Hell he's in New Zealand due to his criminal record in Germany. I figure the real reason the FBI put so many resources on him were the money related crimes. File sharing just happens to be the easiest to score a conviction on.

As for the SWAT Team, the guy giving the video tour is the head of the man's security detail. New Zealand fuzz likely heard the words "private security detail" and went overboard.

I don't like Kim Dotcom one bit. What he did with Mega Upload is bad enough, but his past isn't exactly great either.

But the way they apprehended him was ridiculous. I may not like the guy but there is no justification for that amount of force. If they had evidence to suggest that the guy had a team of heavily trained mercenaries with him in his mansion who were paid to kill any intruders I'd understand. But I think we all know that if they had such evidence they'd have made it public to further criminalise him.

/For shame NZ police, you really went over the top with this one.

There's also that since the guy giving the video tour is the head of the man's security detail, I'd be willing to bet that the whole thing is very one sided in an attempt to make the cops look like the bad guys.

I'd never heard of the guy and still don't really understand all the details.. but megaupload was the best file-hosting site and it sucks ass that it was shut down. I don't understand why it was targeted when pretty much all file-hosts have pirated content on them..

Take five seconds to go read his wikipedia page. Namely Section 2, Insider Trading and Embezzlement. Also mentioned down in the other activities is the fact he was running Trendax, an investment company, without the proper permits. Oh and the fake names on some of his Hong Kong holdings.

The DoJ is indicating he was back to the same tricks with Megaupload and that is why they want him. The file sharing is just icing on the cake, more insider trading and fraud is why the DoJ wants him.

Gotta make those numbers, people! A good example of why applying the same incentive systems used by the Avon Ladies to law enforcement might not have been the best idea.

I'd only add that the more often they use the SWAT team, the more money they can ask from state and federal officials for its maintenance.

Kind of an odd reason to go after him when there's so much of that going on in New York which they've not just refused to do anything about, but actively pretended was something else, even in the face of state AG lawsuits. And when was the last time a SWAT team was used to serve an insider trading and fraud warrant?
