Yup, and it is universal. Cops have been waging war against journalist and citizen journalist since the Rodney King incident. The difference is now the technology is so ubiquitous they can't catch us all.

I not enthusiastic about getting my ass beat by the cops, but sometimes you have to take one for doing the Right Thing. Plus, I can use the fat settlement from the City when it happens.

so what should the cops be charged with? Unlawful arrest, filing a false report, possibly tampering with evidence. What else?

Why don't we have video cameras which can upload the action while it's being recorded to a safe, undeleteable by police, place?

i'd rather develop an application that distributes video automatically to everyone around you. that way the cops have to arrest every cell phone within a 2 kilometer radius to be sure that they got it all.

Racketeering offenses under RICO include obstruction of justice, obstruction of criminal investigations, tampering with a witness, and retaliating against a witness.

Tidbits like this always get me:

The case may further entrench the growing consensus that the Constitution protects the right to record the actions of police officers in public.

I know there are asinine wire-tapping laws that pop up here every now and then, but how in the hell do the citizens not have an absolute agreement that public officials, especially those with the power to incarcerate or kill, should be recorded? This "consensus" shouldn't be growing, it should be as big as it could possibly get.

zedster: how do you arrest someone for just resisting arrest and nothing else??

Under an order to disperse, you are essentially trespassing on public property. Since trespassing doesn't apply to public property, you are resisting arrest when you don't... er... disperse. The same goes for unlawful assembly, some examples of "drunk in public," some examples of "disturbing the peace," and most camping-in-city-limits violations.

susler: Why don't we have video cameras which can upload the action while it's being recorded to a safe, undeleteable by police, place?

If you built the infrastructure, there's no reason why you couldn't. I think the sticking point would be the remote connection - if you were going to use the internet either you'd need a wifi-type connection you were sure was working, or you'd need something like 3g/4g on the camera itself. You'd have problems with data caps on the second one though... none of the cell network providers want to open themselves up to MORE streaming video. If you didn't want to use the internet then you'd have to have a physical base station nearby... but then you'd either have to run it off of a battery or hope that some local shop or home owner is just going to let you plug in your equipment. Both of those approaches have their own problem.

You'd also need additional processing capacity on the camera itself- presumably you'd want to keep the HD version on the camera itself but compress and stream a low-resolution version, and that compression can be a pretty processor-intensive operation.

So... there's no inherent technical hurdle other than you'd need some very expensive equipment, and if you're that scared about your equipment being lost in the first place you probably don't want to take the really expensive stuff with you.

Yes, yes, and yes. What will they be charged with? Nothing. Someone may get a short suspension with pay.

The law is different for them. Remember, the UC Davis pepper spray cop blatantly commited assault and battery on an entire group of passive citizens and no criminal charges were filed.

Because you're always going to have a few people that will always see this as something perpetrated by "the undesireables" in society. They see the people that this is being done to and they don't care because it either doesn't affect them directly, or they see things like this being done to people they don't like (protestors, hippies, etc.) and they secretly cheer. As far as they're concerned, law enforcement can do no wrong.

And those people keep voting for whomever foams at the mouth the most about needing more police, more prisons, more guards. And they never, ever stop to think that, sooner or later, it'll be them and theirs affected.

then some form of breaking the peace, failure to comply with a lawful order, obstruction, interference, etc... should also be included. Charging simply with resisting arrest, a by definition secondary crime, without a primary crime makes no sense
