The Republican National Committee "sent out rules last winter and stated any contest held before a certain date must award its delegates proportionally," Hammond told reporters. "Florida moved its [primary] inside of this date.

Then, shouldn't they have to play by the RNC rules? Yes, Newt is a dick for waiting until he lost to make a fuss, but, that doesn't change the fact that if those were the rules, Florida should have to divy them proportionally.

No, because Florida is already breaking RNC rules by holding the primary when they did. Since they are already breaking the RNC rules, why should they be forced to listen to this other set of arbitrary rules. Newt has a better argument trying to get the whole primary nullified than trying to force them to divvy up the votes.

The 50 was already the "half" amount, since they are supposed to have 99. As far as things being non-binding, I suppose the RNC ultimately decides what they will take and what they will not.

The RNC is going to abso-farking-lutely exactly what they are designed to do in this case, which is exactly what the Democrats did with Michigan and Florida in 2008. And that is, make absolutely no decision on resolving the "controversy" until the race is obviously over and the loser has dropped out, and then make a decision that benefits the eventual winner.

By the way, note that the Republican Party released fark-all in terms of actual rules for what "proportional" divvying up of delegates means, except that each state party is allowed to set a threshold of no less than 50% for "If you reach this amount, you win everything." Unlike with the Democrats, there is no consistent set of procedures, so there's no obvious minimum cutoff or split between district and at-large delegates. Any non-WTA system used by Florida will have to be invented and applied ex post facto.

That's what the judge said about getting on the ballot in Virgina. He said "Well you didn't say these rules were unfair before you didn't get on the ballot" and told him to take a leap.
