There is no indication that the alleged former student was a minor, or that any activity occurred while she was still a student.

In other words, two consenting adults made a naughty video, nothing more.

The fact that one of the participants had been a student, and the other one her teacher at some point in the past is irrelevant.

Many, if not most, U.S. states have policies about revoking a teaching certificate for "immoral conduct"/"unfit moral character" ( as well as alcoholism, felony convictions, etc. ), including New York, California, and Illinois, and being known as the teacher who stars in pornography with former students is definitely going to be an issue in dealing with teenagers. I'd be surprised if Canadian teachers aren't subject to similar rules.

But he didn't post it online where students can see it. He posted it online where adults over 18 are legally allowed to see it. So the students are viewing this video illegally. Is that his fault that they broke the law in order to view it?

I still don't see the problem here. I realize that his students are going to mock him for it, but morally he's done nothing wrong. We're all human, and we all have sex (except some Farkers). He didn't fark a current student. He didn't fark someone under-age. The idea that just because he's a teacher he's not allowed to get his freak on is just asinine.

A well-sexed teacher is a happy teacher. And a happy teacher is better than an uptight grumpy one.

Yeah, they'll use any shred of an excuse to make judgments against any consenting adult anywhere caught having teh sex and get them fired from their job if they can, and teachers usually make easy targets.

Is it reasonable to argue that a teacher believed that teenagers do not look at porn and did not understand the problems it would create for his employer if they found it?

It seems to me that it's not important what should have happened. It's important what he should have known was going to happen anyway. If I know a compact car is parked illegally, I can't get to crush their car and kill everyone inside to make way for my truck just because the compact car should not have been in my way.

The question of whether or not he's done something morally wrong is subjective. The state of Illinois, for example, denied white supremacist Matthew Hale the license to practice law because he was a Nazi. Being a Nazi is not illegal, it's just widely viewed as fundamentally immoral. Certainly, many people would argue that the production and distribution of pornography is inherently immoral for any number of reasons (at least one of which would be the issue of material posted on the internet being readily available to children), and would be horrified if a family member were involved in it.

That said, nobody is saying this guy can't laid. He's completely allowed to get his freak on, even with a former, adult student. He just can't let children watch, and because of the profession he's chosen, he's kind of expected to go a little bit out of his way about that one.

The (blindingly obvious) point was to illustrate that Australia is hardly alone in taking this approach and that it's by no means some kind of recognized norm to accept this conduct among teachers. Thanks for writing, though.

One of my HS teachers had posed for playboy back in the 70s (i was in HS in early 2000s) and the centerfolds regularly made the rounds for each new graduating class. AFAIK there was never any dustup with the administration, although it wasn't porn with a former student and her model career predated her teaching by about 20 years.

We have enough trouble finding teachers who can teach and won't cheat on the tests. Let's first focus on finding teachers we can hold to a higher competency and ethical standard, and not throw competent and ethical teachers to the wolves over their personal lives.

In the age of the internet, people's personal lives are frequently not private. This will be more and more the case. We need to begin setting the precedent now of simply ignoring people's personal lives as irrelevant to their jobs unless they reflect on matters like propensity for criminal violence, theft, dishonesty, or breach of contract---matters directly relevant to the workplace.

...has an entirely different system of LAW than does the US or Canada, (British Common Law roots notwithstanding) and relying on either some state in the US or Canada for analytic purposes is going to lead to faulty conclusions.

And what approach is that, exactly? What has happened to the teacher, yet? The video I saw had a lot of "We're still looking into it and will act appropriately once we know what happened". How do you know that "appropriately" will not include "Two adults, we don't care, but we'd prefer if one of our teachers wasn't flashing his naked pimply ass bobbing up and down where students could see it, as it might affect classroom order"?

If he was farking someone in his bedroom, and a kid climbed on the roof and peeped in the window to watch would he be responsible?

In both cases he's doing something perfectly legal, that only becomes a problem because someone else is breaking the law.

A student doesn't have to see it. In our district even if an adult sees it and turns you in you will get fired because of the "unprofessional" nature of the video. It's complete BS but it happens and has happened before. Like a said a little bit ago, we have teachers and admin people with DUI arrests but those are ok but my god an adult had sex and posted a video of it!!! BURN THEM!
