Women who falsely claim rape should be charged and face the same sentence the victim faces. They should be registered sex offenders too as they are clearly predators and the public should know who these people are. They know they are about to ruin someone's life and do it anyways, they deserve jail and branding so the public can stay safe.

There's only one side of the story in the article. Who knows why he broke up with her. Maybe she'd put on a few pounds, or he'd met someone younger, or she turned up pregnant. There are many justifiable reasons for doing what she did. It's a shame that they are basically smearing her now.

That's great and all, but where do you draw the line? When a jury finds a rape suspect not guilty, or when there's no evidence to prove rape, or when there's clear evidence that there wasn't (in which case it'd never go to trial)?

You don't really want to discourage women from making a legitimate claim even if there's not much proof.

No-- you draw the line if she is convicted of making an intentional false claim. Drawing bruises on yourself to make your fake rape claim more believable is a good place to start with criminal proceedings against you. Lack of a conviction of a accused rapist is an entirely different story.

Woman is bruised up, her clothes are torn, she goes in to police station, desk sergeant says
"What happened to you".

Woman says "grape":

Desk sergeant says "don't you mean rape"

Woman says "no, there were a bunch of them".

Problem is, sometimes it's not that simple. If someone is raped, but there's not enough evidence to prove it, will she be investigated for lying to the police at that point? I do think she should be punished, but I disagree as to the degree. Especially when we have a court system that's based more on trying to convict instead of trying to find out the truth. But, that's just my opinion.

He almost certainly raped her at some point in the past. It's sad that our justice system would take "fake" bruises as evidence that she was not the victim of a man. Of course she is. We need to empower women to do this sort of thing in order to bring men to justice for collectively being oppressive rapists. The specifics of this care are merely details. I hope she gets a good lawyer.

You do have a point, but when I was an officer, we actually would have codes for "good rape" vs "bad rape". I was on a call one time were the women said "I didn't get to finish so yea, I want y'all to take him in for rape". It happens, and with alarming frequency. There really does need to be a way for people who report that to be prosecuted, more than just misusing 911.

Agreed, but I think prosecuting them the same as a rapist sets a bad precedent, and may make some women more afraid to report a legit rape. But there does need to be punishment for filing a false report, especially some involving community service, possibly working for a rape counselor, so they can see what the results of rape actually are.

These decision not to charge here is 50% optics and 50% how things look. The facts of the case don't actually matter because most people don't read past the headlines - some women who see "Rape accuser jailed" in the Sun will not be able to get that image out of their minds and make a truthful accusation of her own.

Or maybe she had a debilitating disease, like say cancer or MS and he had found a younger, less diseased woman, the new woman has scary eyes but he has learned to live with that. Assuming they don't either:

1) immediately side with the accuser and arrest the accused before doing a full investigation,

2) immediately disbelieve the accuser and either blow them off or accuse them of lying.

...and possibly become even better at faking it.

This was not a case of he said/she said. It wasn't a case where a rape might very well have taken place, but there was insufficient evidence to find the defendant guilty. No, it was a case in which she fabricated the story and the evidence. By her actions, her ex risked incurring major jail time. She was willing to make him run this risk because she herself risked almost nothing... In cases this egregious, she really should have to face the same potential risks as her victim.

Yes, but we both know not every case is as cut and dry as this, and I'm sure such a law would backfire, especially in the case of an actual rape where the perpetrator is a cop.

There already are criminal statutes covering perjury and making false police reports. Why aren't those good enough? Particularly when, according to the FBI, the rate of false rape accusations is the same as the rate of false accusations of every other crime.

Yes, that actually happened. And this is a part of why actual emergencies are handled as badly as they are. When you get seven rape calls, and six of them end up being like that one, it makes you go into the legit call with a nasty attitude.

I find it hilarious that somebody believes that police investigate.

This is what police actually do:

1. Raise revenue via traffic and parking tickets.
2. Listen to both sides and guess who's telling the truth, and take appropriate action.
3. Get rid of undesirables.
4. Fill out paperwork for insurance purposes.
5. Serve warrants.

Outside of murder, police don't investigate, don't attempt to prevent crimes, and don't try particularly hard to catch bad guys.

Keep in mind, I'm not saying that is what bad cops do. I'm saying that's what they get paid to do. They're just doing what they're told.
