FTA: "The Motzneys' attorney, Andrew Laskin of Robinson & Yablon, P.C. in New York, has handled 13 of the suits, he said."

That's an awfully specialized area of the law, no? I wish he had a TV commercial. "Has your child lost a toe in a croc accident? I'm the leading croc injury attorney in the country. Call me."

I'd wager that Crocs are slightly safer on an escalator than flip-flops. Little Suzy got her toe sucked into the escalator--OMG, it's because of faulty shoes!

/Parental responsibility, how the fark does it work??
//No, it's not he fault of the elevator company, either--as long as the maintenance is up to date
///Mallrats aside, watch your precious snowflakes when you've got them around moving parts, okay?

This particular claim is not unheard of. It's become kind of a cottage industry over the past five or six years. I told my wife to not buy our kids Crocs when I heard of these suits quite some time ago.

On one hand, yes, these shoes are clearly not designed to protect your feet from daily life in an urban environment with moving parts.

On the other hand, you should be able to figure that out just from looking at them.

Well, I guess those are kind of the same hand.

Are we really into "precious little snowflake" territory when you are upset that your kid's toe was ripped off due to the shoes she/he was wearing?

I don't know about you but I think the parent has a right to be angry over this.

Having had some exposure to safety and liability issues, I have heard a lot of horror stories about Crocs getting chewed up by escalators. I think the issue is, Crocs are solid enough for parents to think it's ok for kids to go outside and play in -- much more so than flip flops, anyway -- but they're just soft enough to get sucked into escalators.

By this point though, I hope enough parents know about this risk to 1) be careful with their kids around escalators and 2) buy their kids some real shoes.

Sometimes I wonder just how cheap and easy life would be if people took responsibility for their own stupidity and our courts were not clogged with frivolous lawsuits like this.

I'm going to just go full force and say I'm glad the kid lost a toe - it will teach them to watch where the hell they are going. In a perfect world the parents would be made to pay a hefty fine for clogging up our judicial system.

No arch support, so they're not good for sustained walking, but comfy as hell for most applications.

Their non-boat shoes are pretty nice actually. The new stores relegate the funny looking shoes to the back wall.

2012-01-27 05:19:49 PM
I used to be an avowed Croc hater but no more. I am comfortable in them, and anyone who is offended by my shoes (which is ridiculous) can sit and spin. And if you look at the website, they have so many new styles that look nothing like the original Croc of old.

As far as this story goes, I think the blame can be split evenly between the two sides. It would behoove the Crocs company greatly to somehow figure out a way to force the customer to acknowledge the escalator danger before they ourchase the shoe (if buying online, this would be as easy as having the customer check a box for example). But by the same token, I think the parent should have been paying closer attention to the kid. There is no reson why the kids foot should have been touching the side of the escalator. I have tripped on escalators wearing all types of shoes. There is a safe way to ride the escalator, and if your foot is touching the side enough to get pulled in then you are not riding safely.

When those wear out in a few months, try a pair of Crocs. Much better for walking, and at least as comfy around the house. Plus they last far longer than slippers.

Ugly, hate 'em, but I would have loved a pair over the summer. Cape Cod beaches are rocky, and these would have made getting in and out of the water significantly less painful.

Jelly shoes were big when I was in middle school, I guess the plastic Crocs are just this generation's version of that trend.

2012-01-27 05:52:18 PM
It looks like there is a legitimate design flaw in Crocs that alows them to get caught in escalators. They need to fix the design flaw or otherwise put a huge warning on the shoe itself or stop selling the product, period.

2012-01-27 05:52:50 PM
They should sue the relative that gave the kid shoes.

/fear and respect the escalator

2012-01-27 05:55:27 PM
Crocs puts a warning tag on its children's clogs, Laskin said, but it is one of three tags that are easily overlooked. "We maintain that warning is insufficient."

Disbar their lawyer, beat them both down to the ground with a host pipe, and give the daughter some candy and good children's book.

No one should be in favor of MORE warning labels. Freakin' America has 1000% too many already.

Danger: High Voltage GOOD

The lawyer version of This shoe is not a steel toed boot, you morons. BAD

Crocs should not have a warning label. It's inherently obvious.
