If he lost his ownership of it after the insurance paid out, wouldn't it belong to the insurance company, and not Spain? Although, I do believe the rule of Finders Keepers might come into play here.

A 26-foot Regulator is pretty far from being a rowboat. It is a pretty serious boat. Also, it was kind of a miracle that the only thing that was ejected within reach of a heart patient was a floatation device. It is also a near miracle to be in the water, off that part of Nantucket, in 6' plus waves and survive.
