Shouldnt it the banks that used S&Ps rating service be the ones suing and not Illinois.

The banks might have a case, as the party that was "wronged".

The problem is the ratings agencies become quasi-governmental in the mid 70s. In the 70s the ratings agencies also switched to charging the issues of debt and equity securities instead of charging potential customers.

Which means the banks that were buying the securities werent really customers either.

Bad business models lead to bad information.
