According to the comments the judge has not specifically ordered an appearance. The judge has refused a request to excuse the president from appearing. The consequences of not appearing are up to the judge to decide.

The judge probably doesn't care if he appears. If Obama blows off the hearing the judge finds him in default and strikes his name from the ballot. More likely the campaign sends over a lawyer and a witness to swear that this is a certified authentic copy of a Hawaii birth certificate which the court is bound by the "full faith and credit clause" to accept as prima facie evidence of the facts stated on its face. Then the burden shifts to the challenger to show some evidence that the certificate is false.

This is tricky: If Obama does show up, it may take several days of testimony to determine he is a fraud, whereas if he refuses, then Palin gets sworn in during that same time slot - the problem is that Palin already has a spa appointment scheduled for the same time, thus leaving our beloved country without leadership. Until she could be properly sworn in, anarchy would reign supreme.

Can someone explain to me how Obama's corporeal presence would affect the issue at hand? On the one side we have the two birth certificates that speak for themselves. On the other a wingnut who will be unable to explain why those certificates are fake. Why does Obama have to be there to hand in the forms?

Since Obama's Daddy is from Kenya and a British subject (or was), they find him ineligible to be Prez.

The Presidents lawyer in this case submitted a rather idiotic reason for throwing out the complaint. My guess is that he will get it right by thursday.

Yeah. It sounds like judge didn't like their reasoning, or lack of reasoning, for dismissing the subpoena. "He doesn't have to appear" wasn't good enough.
