Only if it is also illegal where you live.

FTA: Part II of the controversial Extradition Act 2003, has a 'dual criminality' requirement. This procedural step requires conduct to be a criminal offence in both the UK and the US.

Judge Purdy was satisfied that the alleged conduct was a chargeable criminal offence in the UK, namely s107 (2A) of the Copyright, Designs and Patents Act 1988.


So he was (arguably) breaking British law, too. I agree, the hook upon which U.S. jurisdiction is hung is pretty scant, but it's not like the U.S. is prosecuting him for conduct that was legal in Britain and only illegal in the U.S.

Well, I think the logic was that he was serving customers (I guess getting ad revenue? I'm not familiar with the site) in the US, facilitating law-breaking here. So more like requesting the extradition of someone involved in international mail fraud from a country where the mailings don't constitute fraud necessarily.

Once your service crosses international borders, both nations have some claim to jurisdiction, albeit generally the one you're not living/based in can only exercise it if the one you are based in agrees to let them have you.

Basically, it doesn't really seem like this is quite as arbitrary as your hypothetical example. IP law has always not been entirely consistent as far as international companies are concerned, there have been other cases where the RIAA/MPAA, especially, have gotten requests filed to allow them to sue/prosecute internationally and they've been politely told where to shove it.

Copyright law for the most part is governed internationally by a series of treaties. Thus, an author (creator) of a work typically only needs to register it in one country and can enforce it in countries which recognize the registration. This is not uncommon. It also predates the internet by about 130 yrs or more. But hey, why let things like facts and laws get in the way of a good rant?

The US took this sort of action against people who ran betting websites from Europe. Even though it is perfectly legal where they were based the US had the British boss arrested. Link

He hadn't broken any laws in the UK. But the US decided they had jurisdiction over his company.

That would be a great point if someone was arguing that the copyright wasn't recognized in the UK, we aren't.


If what he did was a crime in the UK he should be tried in the UK, since he did it in the UK. If it wasn't a crime there is no reason to extradite him.

ICE has already pulled the domain name from TVShack a number of times -- The site kept changing countries, and finally changed the domain name to TVSearch.co. It's currently offline yet again.
