Ah, Copyright laws... the way to make sure that people who had not a single thing to do with creating something get to profit from it for decades after the death of the actual creator, many times when the actual creator didn't get a thing out of it.

I can see having copyright laws last for the life of the creator. But after? fark it.

And if a property is owned by a corporation? Maybe they get to hold a copyright on it for as long as 40 or 50 years, but that's it. But stuff that was created during the motherfarking great depression should not be clogging up courts to see whether a corporation or a creator's cousin's brother's uncle's nephew's twice removed aunt's chauffeur's brother should be the one who gets the copyright (like is currently happening with Superman).

Article says you can't watch a copy on YouTube. I did that day, and from what I could see there were many available. Haven't received a bill yet.

On the other hand, his children making money off of a public speech is pretty awful. Judged by the content of their character? They're jackasses.

I remember in high school when the Detroit Free Press made their entire front page a blank white, with the speech and nothing else printed on it, for MLK Day.

The family sued, and only backed down from tremendous pressure and bad press.

One of the few pleasures in my life was calling the Librarian of Congress a farking liar to his face (and proving it) after he asserted, during a talk at my law school, that the sudden extension of copyrights he proposed just as Mickey Mouse should have come into the public domain was pure coincidence and had nothing to do with Disney.

The fact is, the very idea that a performance is a commoditizable thing deserving of property protections is less than 125 years old and may be one of the greater legal mistakes we've ever made. These protections don't make the performers rich, just large media companies. So in present form they are useless as a way to promote the useful societal purpose (encouraging more art and rewarding artists) they once had

umm. Folks the article is pure bullshiat. I can't do it now because I'm at work and streaming media is blocked. But I have pulled up the I Have a Dream speech many times. One must pay to use the video ONLY if you are using it for commercial purposes.

This is just more anti-SOPA/PIPA crap (as if it is necessary).

I do feel for the kids somewhat. Their dad was an American Icon, a legendary figure in our history. And unlike ex-presidents, or generals, etc who can go on speaking tours and deliver six-figure adresses after their public service is done to secure their family's future; he was never given that chance, but instead eas taken from them violently and horrifically at a young age leaving nothing but his legacy behind.

I kinda feel like some sort of IP "eminent domain" should be exercised here. The kids get a, one-time, 6-7 figure, check and then everything he ever said, or wrote is in the public domain for good.

Classic example of troglodytes in control of intellectual property.

They want $10 for a copy of this. I presume that's DVD, in a case, shipped. At a minimum this is going to cost $2.50 to produce and ship and they might sell a few thousand copies a year. So maybe $75k a year, max. And then they have to deal with people reselling used copies at $5 or less, so their annual sales go down further.

Or they could still enforce their copyright claim while posting a selection of videos on an official YouTube partnered channel. Figure 50 million hits a year easy as students are sent to watch speeches and the ad revenue just comes in. No one can resell their content, they don't have to arrange production and distribution, and the message can reach further.

It's a classic example of people struggling to make dollars when pennies are raining all day.

Inasmuch as this whole thing came from one stupid blogger, who doesn't know what he's talking about, and so many people are going ape-shiat crazy about it proves that some people will believe anything they read on the intertubes.

The StuidFA says that you cannot find the speech on YouTube. Well, well, well. Just google "i have a dream speech" and the YouTube link is the very first one. There are thousands of others. Why? Be cause the video of the speech is in the public domain and can be used for any non-commercial purpose.

But I guess biatching and moaning is more fun than the truth,
