Is assault a more serious crime if you do it to someone that is homeless? What if I beat up a home-owner? Is that less serious than someone who justs rents a condo? John McCain owns more houses than he can remember. It should be totally legal to kick John McCain's ass.

Perhaps you can convince me through reasoned argument that my position that wealthy people with a bit of "celebrity" to their experience, coupled with some sense of superiority for having successfully sold a lot of yoghurt, aren't just about as useless a random homeless guy on the street?

Anyone remember that show Third Watch? There was an episode where a homeless dude was siphoning gas, so a valet struck him in the skull with a hammer... Then, when the cops were prepared to arrest the valet, the bum threw the stolen gasoline on him and lit him on fire, which was admittedly a weird turn.

And are also some the most confrontational people in our society. I have seen a number of instances where homeless ask you for something, then retort with nasty insults or threats of violence when you don't give in to their demands. If you do anything other than ignore them, things can escalate very quickly in a very bad way. Doesn't help that many of them have mental health issues, but not to the severity where they can be involuntarily committed.

I do not condone what Mr. Lee did, but I'm not going to shed a tear over some aggressive transient's head being caved in, either.

Sure, if you're actually trying to kill the guy. If you're just trying to "teach him a lesson" and/or blow off steam, it'd be a bit overkill and over in a fraction of a second. This doesn't sound like a fight, this sounds like a beating.
