You know, in cases like this where the victim actually died, I'm good with having a murder charge levied instead of assault. The person was dead and would have remained that way without outside interference.

I think that's a good idea. Similarly, some guy here just shot a hole in his apartment floor and missed his neighbor's two-year-old by inches. I feel like if some miracle occurs and someone doesn't die, that shouldn't help your case.

Criminal mischief seems appropriate. Anything more will likely get tossed out in court... These kids couldn't have known there was a person below them when they did this, they just wanted to see what would happen to the cart. We all did similar things as teens, it doesn't make us murderers.

We could sentence them to death and then revival. A temporary flatline of sorts. There's a shopping cart's chance in hell we'd be able to pull it off but it would be satisfying either way.

I tried to walk into Target, but I missed.

I think the entrance to Target should have people splattered all around. And, when I finally get in, the guy says, "Can I help you?" "Just practicing."

by law, at least in my state, death is defined by irreversible cardio-pulmonary cessation. it being reversible categorically means that death never occurred.

I mean, 12 years old. it has to be possible that they can be saved. I remember that famous guy who was a 12 year old rebel fighter in africa who has gone on to speak against children soldier indoctrination and tries to help the world. I mean, he was walking around drugged up with an AK as a pre-teen working with a paramilitary group, and now he's a leader of this movement against such violence.

the scary part is that we have a society in america that can create children that are about as callous as the children raised on AKs and cocaine in paramilitary groups in africa.

/ btw, children scare me much more than adults. they don't have functioning frontal lobes. children, given the opportunity, are much more likely to commit murder than adults in the same situation. the bible was right, they're natural born sinners.

/Also, If he's mostly dead, he can still be brought back if he has some noble cause to live for. Like True Love.

I agree with your Kantian approach to criminal justice. It is the intent that is condemnable, not the result. Ineffective criminals shouldn't be given leniency for their ineffectiveness.

although, that means that the guy on the Big Bang Theory show is a mass murder for all the times he's tried to explode people's heads with his mind

Except they were joking around and not horrified that a woman was nearly killed and has a profoundly changed life as a result. I get what you're saying, but most people would be shocked and upset that they actually hurt someone doing something that yes, all stupid kids try. We once tried to "play space camp" with my sister -- the plan was to hook a rocking chair over the balcony and tie my sister in with belts and Nintendo controllers. If we'd done it, she would have been hurt badly at the very least and we'd have been HORRIFIED even though we were just playing what seemed like a logical game to our kid brains.

Really? They should be charged with attempted murder and felony assault. They were farking laughing about it to the police..that they permanantly farked up some woman's life. Perhaps they should be permanantly farked up to show them how humerous the situation is. I bet they torture small animals too.

costco is right below and so is the taxi line. someone is ALWAYS right below. even if it hadnt been a person walking it would have been a car leaving the lot and its well lit enough so that you can see clearly.

Send them to a psych ward and keep them there until they can emotionally understand the implications of their 'fun' and then give them a year of community service caring for other traumatized persons with similar issues. Sending them to juvi or jail will just turn them into a source for more problems later when they really will kill someone else.

if they are puerto rican then they are american citizens. most p.r's in nyc have never even been to puerto rico other than on vacation and barely speak/understand any spanish.
