Sybarite: Lot of trouble to go to. Why not fake an illness like everyone else?

Because sick pay is deducted from a teacher's allotted days off. I don't know if it's still the case but years ago, you could save up all your vacation & sick days & they'd be added to your pension. Jury duty is a freebie.

stpauler: Old school email:

I was an honor student throughout school and my father was always aggravated that he'd have to write a letter to explain the few times I was out. So, he'd either write the most sarcastic notes or just make up wild shiat. I remember a couple:

"Please excuse Brigid from being out yesterday, as she was absent."

"Please excuse Brigid's recent absence. She was abducted by a UFO and it took us some time to contact NASA to mediate the negotiations for her return."

"Please excuse Brigid's absence yesterday. She didn't finish her chores so I had to tie her to whipping post until she learned her lesson."

And, finally, the one he used throughout my senior year of HS:

"Please excuse (circle one) [Brigid, Patrick, Richard, Marie, Alex] from (circle all that apply) [school, gym, sports practice, meeting with principal, math class (because math is the Devil's tool)].

/Dad was a piece of work
//They never accepted my skipping math class, though.

How often can they call you in for Jury Duty? I swear, my morning guy has claimed he's had jury duty 3 times in the last 6 months. I'm one more minor infraction away from making the lazy bastard bring in the letters to prove it.

The thing that tipped the principal off wasn't the spelling or calendar errors, it was the signature at the end. The notice was signed "Epstein's Mother".

Not in Illinois. Here it's one time per year, whether you serve or not. (Not that people actually get called more than once every many, many years - it's just legal if they do).

Varies from state to state... I've been called 5 times in ten years, but have never served.

I assume it varies then? I was called for Jury duty twice, 13 months apart. Although I didn't serve the first time, as I got disqualified due to my bleeding heart liberal anti-cap punishment stance.

This was when I lived in Tallahassee, FL.

If I'm not mistaken, it's the same here in California. If you go in, you're done for the year.

A quick google search says not more than once in 12 months in KS. You might want to call your local district courthouse and ask the clerk...

In NJ, you can get called every 6 months. If you served within 6 months, they'll defer you for another 6 months if you send a letter & proof of prior service. That being said, I've lived in NJ for over 30 years and have only ever been summoned twice--first in 1988 (when I was a full-time student & didn't have to serve) and last November (where I goofed off in jury holding for 5 hours before being thanked for my service).

suburbanguy: A quick google search says not more than once in 12 months in KS.

There seems to be a similar law in Connecticut just interpreted differently. My wife was called in May and again in October when she claimed an exemption they informed her "No more than once a year" means you don't have to serve twice in the same judicial calendar which cycles August 31.

That's funny until you get pulled over for speeding, and they arrest you for contempt of court for failing to appear if you were called for duty.

DrewCurtisJr: That she gets to keep her pension or that she gets a pension after 8-9 years?

In NY, teachers become "vested" in the pension system after 5 years, but do not receive anything like full pension until X# of years and age X.
When they want to reduce costs and purge the old-timers, they offer a 25/55 plan (if you're at least 55 and have worked 25 years you get full pension). So, in a non-incentive year it's bound to be higher. When I'm 55, I'll be at 25 and if it's offered, I'm freakin' taking it!

The point is that even if she gets a pension (which she's earned and paid into) she won't receive a living wage from it, just some beer money.

As for keeping the full pension. Again, it ain't much, and it prevents lawsuits, appeals or arbitration. It's likely to be the cheaper way out.

Just got off the phone with the courthouse. They said that once you're chosen as a sworn juror, they can't call you in for a year from that date. But if you've never actually served on a jury, they can call you in as many times as they want.

So, he's probably lying, but It doesn't look like I'm gonna bust him that way.

I've lived here for 11 years and I've been called in for jury duty twice. That fat bastard gets called in three or four times a year. Something just doesn't smell right.

Also, Federal District and State (County) courts run on different schedules, and being called for one doesn't exempt you from being called for the other.
I've been called 5 times (3 for State, 2 for Federal). They like me. (or my SocSec#)
In some states you're "on call" for several weeks and have to call-in once a week to see if you've been selected to show up that week.
Also, serving in a Grand Jury is a 6 month service, IIRC.

Your employee has the opportunity to obtain some sort of proof, signed by the Jury Administrator or Clerk of the Court that he did, in fact, show up. You don't have to just take his word for it.

Back in either 2000 or 2001 I was summoned for jury duty 3 times in about a year and a half. I went the first two times and we were all dismissed early because we weren't needed. The third time I just sent the summons back and checked that I already had served. But since then I hadn't received another summons for jury duty until the other day.

If someone pointed this out already, my bad...

Opening of article: "This is one teacher who is poised to learn a lesson in good spelling - and the law."

Later in the same article: "She wan't very good at being creative," Condon told Slattery. "The letter had wrong dates, wrong room number, wrong address, different words misspelled. She had not done any jury duty."

Looks like spelling is an issue for more than just the alleged perp in this case...

I got a warrant for failure to show up for jury duty once. The notice never showed up at my parents place(in SC), but they found out about the warrant a month or so later. I was no where near SC when they claimed I was suppose to show for jury duty. I had been in MI for months with my own place, MI DL and a job. My parents explained to them that I moved, but they won't listen. Oh well I have proof and don't miss that state anyway.
