Obama only wanted to close the literal Guantanamo facility. The plan was to ship Gitmo prisoners to a location within the continental US. Congress blocked funding of this move. Obama has no compunction about locking people away for years without charges or access to the legal system.

There's an administrative process. It may not be a trial, but you don't get on the list for no reason.

An administrative process held in secret, with no rules of evidence, no chance of repudiation and no meaningful way to address what happens when it gets things obviously wrong. At least the German Jews knew who they were.
