My husband's league is at least a dozen people, no money involved. It's more likely than you think! (We're all geeks anyway though, we met these people through WoW)

tl;dr version
Federal law does not consider fantasy sports to be gambling. Maryland law is ambiguous. This guy wants Maryland law to clearly state that fantasty sports are not gambling.

The funny thing is..they try to cloak "gambling" as a moral sin, but it's ok if the state rolls a gambling boat, and gets their cut of the money.

You can play without an incentive at the end (i.e. money), but it removes a lot of the competitiveness when you don't have a prize. I can tell you now I didn't give a shiat about my teams in the leagues where no one payed. I traded random guys to watch others lose, pulled players to let others win, and generally screwed with the entire season. Hell one of the guys said his "friend" was taking the 10th spot, when it was really just him on a ghost account.

That doesn't happen when money is at stake, especially if it comes out of your own pocket.

So what is the "element of chance" in Fantasy Football that the state believes makes it fall out of the federal exemption from gambling laws?

I don't play fantasy sports. Do the players flip coins or draw straws or something to decide who gets to pick players first? If that is the case, all you would have to do is introduce some kind of competition in the beginning to decide that and remove the element of chance. Perhaps rock, paper, scissors would be a good idea or a maybe set up a big screen TV with an Xbox and people play Maddon Football games in a single elimination tourny to set seed for everybody. You could call it a "Fantasy Pre-season" if you will.

I'm glad to see a legislature do something which results in *fewer* people being prosecuted, but it seems like he only cares because he happens to play FF.

I don't play FF so I don't know if this is already prohibited by its rules, but what happens if all my fantasy players happen to play for the Saints? At that point aren't I basically betting on real-life sports, and if so am I no longer exempt under this law?

If you're referring to TFA, you clearly didn't read it. In many cases, though, the veil of decency is cast over what is purely an economic concern, and yes local governments play both sides to their own advantage.

In SC you can't even, by law, play for fun any "game of chance." I don't know how our state treats FFLs but knowing our backwards legal system it is most likely completely undefined so as to allow for Good Ol' Boys to get away with it while unconnected folks can still be eligible for punishment.

Everyone quits playing halfway through the season with no money on the line, I only did that once. Same league was for money the next year.
