Well, in his defense, wearing the shirt is protected by the First Amendment. It's probably not the smartest thing for him to do, but theoretically, wearing the shirt should have no bearing on the proceedings.

Then again, communism is a great idea in theory.

My wife is an attorney. You wouldn't believe some of the shiat people wear to court. Marijuana leaves, gang dress, one guy actually showed up shirtless and wasn't allowed in the court hourse!

This is actually a more common occurrence than you might think.

I had a client who was charged with a weak case of simple possession of marijuana.

My client claimed that he didn't smoke marijuana, but showed up to court wearing a shirt with an image very similar to this (new window in case hot linking doesn't work).

I spotted his shirt before the DA or the Judge entered the court room and made him go into the bathroom and turn it inside-out. The case (based on constructed possession) was dismissed, but had the DA or Judge seen my client wearing such a shirt it could have turned out the other way.

/Not the smartest client I ever represented, but he was a funny and one of the most likable.
//He was murdered last year. No suspects, no motive. Sad.

As a foster parent, I've been to a bunch of family court hearings. It's *AMAZING* what people will wear to them. I mean, you are standing before a judge who has the power to literal rip your family asunder, and you show up in a dirty t-shirt and spandex pants? *REALLY*? I mean, you could get a nice blouse and a presentable pair of slacks, or a modest skirt, for a total of $10 down at the local Salvation Army thrift store, so you can't cry poverty about it.

If you're presiding over a jury trial and a defendant on marijuana growing charges comes in in a NORML t-shirt and reeking of weed, are you going to tell the jury to disregard his appearance?

The First Amendment doesn't mean that you can't have your statements used against you.
