Possible, but unlikely. Kleptomania is a condition about which little is known. There are tantalizing hints that it may be rooted in organic brain function - but basing a legal defense on it is "iffy", at best.

So which part was the owning up and taking responsibility? The claim of it being a cell phone distraction? Then the claim of a benign tumor? Or the fact the tumor makes her distracted, absent minded, and forgetful, but that is surely no reason she can't fulfill her obligations.

This is what being accountable has come to mean to politicians and news agencies. They are as transparent as an xray vest.

For a first offence it's not unusual to be booked and released the same day pending a hearing.

If I was out shopping and got a phone call telling me that I had a brain tumor I would be a little distracted. If that is the case I don't have a problem with giving the stuff back, paying the fine and doing probation.

This is what they call "arguing in the alternative," a perfectly acceptable (though rarely effective) legal strategy. It was illustrated to me in my first year of law school in the form of the "goat defense":

1. You never had any melons.
2. If you did have some melons, they weren't eaten.
3. If your melons were eaten, they were not eaten by a goat.
4. If they were eaten by a goat, it wasn't my goat.
5. And anyway, that goat's crazy!

Doing some x-mas shopping at Sears this year I picked up a car seat warmer. I was already carrying several other bags. I was looking at TV's and ran into a friend of my wife's that I don't really care for. She starting her yaking, as always, and I finally told her I had to go. I walked out of Sears and was halfway across the mall when I realized I never paid for the seat warmer. Hey, free stuff!

Release of medical records, and a complete financial disclosure showing she routinely made purchases like this or she is just a common dumb thief.

On top of that, I don't understand how you can 'treat' a tumor so it's no longer a problem. It's not like it's a sprained ankle. I just had a friend who had a brain tumor removed, and the only "treatment" pre-surgery was routine surgery prep stuff. I get that everyone is different, but they make it sound like she had some sort of miracle drug treatment to make her all better. If that is the case, then she is a medical miracle.

Also, if she wants to truly accept the consequences of the issue, then fire the mouthpieces and come take your lumps in front of the press first-hand, babycakes. Until you do that simple thing, you are running from the consequences not accepting them.

If that is a valid defense, It's also a good reason for her to step down from her position. If her tumor causes that kind of lack of judgement, she's not qualified to represent the people of SF. well, on second thought....

Yeah, this is what is really the outrageous part. I'm sure that lots of first time shoplifters get light slaps on the wrist if they're otherwise presentable, that's not the story. The story is that she thinks that something that presumably made her brain malfunction is not an issue when continuing on the job of concentrating on important decisions.

This is why many of the political sex scandals or drug problems are not just private but actually relevant to the politicians job -- politicians whole job is (presumably) related to making decisions based on political judgement. If they show they are impaired in their ability to make decisions or understand citizens will judge their acts, they are simply unsuitable to the job.

Australian FEDERAL politician Mary Jo Fisher. Also going the shiat flinging monkey defence. ie. Fling as many excuses as you can. With bonus crying, of course. It seriously seriously makes me wanna puke.

I think she got let off the charges in the end. I haven't got the stomach to find out. The trial was mid way thru the last time I heard about it.

The police apprehension report into the incident alleges that Senator Fisher allegedly took foodstuffs valued at $92.92 from a Foodland supermarket in the Adelaide suburb of Frewville.

She is further alleged to have assaulted a female security guard in the supermarket carpark when the guard sought to stop her from leaving.

In a statement today Senator Fisher said she rejected the charges "and will vigorously defend them".

She told the court she had been diagnosed with chronic depression and had hit rock bottom at the time. She said she was feeling out of control and anxious as she went through the supermarket and was physically overwhelmed by the time she got to the check out.

"I was focused on getting the hell out of there so I could deal with the physical symptoms, I don't recall thinking about anything else."

She went to her car and felt totally bewildered when approached by the store security officer, Cathryn Groot.

When Ms Groot took her to the security office and spoke to her she began to realise what was happening.

"I was concerned that the awful truth was dawning. That I may have come out of the store with some goods that I hadn't paid for."

She described her depression as her dark secret, saying she hadn't told anyone aside from her family until she was questioned at the supermarket by police.

The senator broke down in tears as she told the court 2010 had been a bad year for her. She had been looking forward to getting home and seeing her family so she could get better, it had been a last minute decision to go to the supermarket.
