Non-compliance with MUTCD is however a defense. The signs must conform to the manual and putting bags over them is not in conformity.

Fight the ticket, show them pictures of the bagged signs.

Dead for Tax Reasons: It's a construction zone. Usually they cover up the regular speed limit signs and post construction zone signs and lower limits. If the construction limit is 45, why confuse with signs that say 55 too

without another posted sign, what is the law?
a construction zone sign, without a speed limit sign, is pretty much a vague noticed at best that construction may be happening ... whatever

I guess without a sign, you can drive at whatever speed is safe for conditions.

All states (or is it national law) have laws that say if there is no speed limit posted, the default limit is xx. The tickets are just a sweet money grab for your safety.

You can reverse engineer the street - measure the dimensions, figure out the traffic flow, and look at the streets around it, and then consult with the state DoT guidelines to determine what the range of speed limits is, and then pick the lowest one. If you can't be bothered to spend a few hours doing basic civil engineering research before getting on a road, well, there is just no helping you.

I believe that here in Virginia, that if its a construction zone on a highway, the default is 45 mph, unless otherwise posted, non highway? 25, unless otherwise posted. and either is well coned off for a half mile in either direction, with a trooper idling there with lights on waiting for someone to mess up.

anywhere else in the country? unless it is the high dessert, I'm assuming the speed limit is 65mph on a interstate and 55 in urban areas.

I've been through that zone. They have temporary speed limit signs up on the "Construction Zone - Men Working" signs. The "regular" speed limit signs are bagged, but there ARE speed limit signs posted.

Here in Ohio, any unmarked state route (important distinction, local roads don't count) has a speed limit of 55. There's some ridiculous psuedo-legal guideline for determining "unmarked" that involves counting telephone poles. Which probably makes no difference whatsoever, because I'd guess less than 10% of the population is actually aware of this default. Unmarked routes get speed limit signs really quickly after someone going 55 hits someone who is going 30 because they can't figure out the speed limit.

However, covering speed limit signs with bags and then not replacing them with a revised sign is BS. Nice work, Florida!

Seen the "default limit is..." sign at colleges only.

IIRC from my drivers ed class many moons ago here in Fl. default for residential is 30, everywhere else is 35 or 45 for major thru way. If major thru way has lots of traffic and stop lights, back down to 45.

And, according to a buddy who is a LEO (not a cop, an officer of the law - he's one of the 1%) anything less than 6 over is a warning anyway, they can't write a ticket for a fine, just a warning. So when in doubt, 35 to 40 won't get ya in trouble....

PA law is 55 unless otherwise posted. They do have the sign, but only in a few places.

In Texas the speed limit is 30mph if no sign is posted/present. Many states have similar laws on the books.

Florida speed limits are set by using the 85th Percentile method - setup a radar gun, clock people for a week, set the speed limit to a value that covers 85% of drivers traveling on the road (not to exceed the maximum speed allowed by law).

Depends, is it a clearly marked construction zone? Is the construction zone active? In many places they will still have the barrels but at night it reverts back to its normal speed limit. For those that say "unless otherwise posted" how far back was the last posted sign?

/I don't think I can make the call without more information. Glad everybody else can.
