I wish I could tell you that Obma fought the good fight, and the Republicans let him be. I wish I could tell you that - but Washington is no fairy-tale world. He never said who did it, but we all knew. Things went on like that for awhile - Washington life consists of routine, and then more routine. Every so often, Obama would show up with fresh bruises. The Republicans kept at him - sometimes he was able to fight 'em off, sometimes not. And that's how it went for Obma - that was his routine. I do believe those first two years were the worst for him, and I also believe that if things had gone on that way, this place would have got the best of him.

I wonder if this country will finally start considering prison rape a crime and stop thinking of it as a bonus punishment or if we'll still make jokes about it and/or pretend it doesn't happen.

DamnYankees: Most crimes are defined by states, and AFAIK male's can be subject to rape in most states, certainly the ones we studied in law school.

True.

However, the federal definition was different; and although that doesn't much matter for law enforcement purposes, it DOES matter for statistical and legislative purposes.

Presently, the DOJ only counts "carnal knowledge of a woman not the perpetrator's spouse by force without consent" among their stats of forcible rape; everything else goes into sexual battery statistics. This skews the number of rapes downward by a significant amount, and puts the forcible rapes of men and children in the same class as sexual misdemeanors.

This new classification will make the number of apparent rapes go up in the short term; but the per capita will be more realistic.

I think this mostly affects the collection of statistics. As others mentioned, the prosecution of rape happens almost entirely at the state level.

The irony is Republicans get to slam Obama for "overstepping" on states rights or some derp like that, and later when rapes "increase" because of the more inclusive definition. I would say that this is a win for Republicans, but mostly I think they'll just make themselves look even more disgusting to the electorate like they always have.

I was technically raped by a girl in college. Several of us were sharing a hotel room for a bowl game, and I passed out in my bed at sone point. Later I awoke to a girl we let stay with us going to town on me. In my confused state I obviously ket things continue. And while she was someone I had avoided hooking up with before, I won't say I felt actually violated or anything. I consider it a funny story now. But I know for damn sure if that happened to a girl, that guy would be in jail.

Prison rape is 100% preventable by not being a farking scumbag criminal in the first place. No sympathy at all for somebody getting a little unwanted butt sex.

then why not give the courts the option of sentencing someone to rape? y'know...2 years probation and one rape for jaywalking. or 18 months and two rapes for minor possession charges.

Which begs the question...Who among us would rather get two minutes of anal rape instead of two years of probation?

Like I say every time this argument is used: If you want prison rape to be a bonus punishment, make it actually part of the sentence. Don't sentence a man to years of incarceration, nominally under the protection of the State, with the expectation (and in some cases, sincere hope) that they will get raped while inside. A prisoner is supposed to be under the protection of the State, don't consider the State failing in their duty as some kind of just comeuppance.

And you know what, even still? Assigning rape as a punishment sounds like something out of a barbaric hell-holes worst nightmare. It is cruel, unusual, and utterly unbecoming of a country that claims to have just laws to think of rape as some kind of legal punishment.

usernameguy: It also now includes sex with someone who can't consent due to intoxication.

I have never agreed with that definition.

There is intoxicated (passed out) and there is just wasted. My wife and I have some of the best sex when we are BOTH wasted. Does that mean I have raped my wife dozens of times just because she wasn't sober enough to drive?

Seriously, if a drunk, but conscious woman gets in the car she can be arrested and imprisoned because she WAS responsible. But if she has sex she is no longer responsible for her own actions and is a victim. I never could wrap my brain around how we got to this point. It is like society is still infantilising women. Anyway, if a person is unconscious I DO agree that it is rape rape. If she is just drunk and making a bad decision it shouldn't be.

bibli0phile: You do understand that in a modern prison, 1 officer is used to monitor about 200-400 inmates (medium security-vast majority). It is impossible to completely prevent these actions unless massive money is pumped into the system.

Which is retarded in the first place but then they let them all intermingle.

Keep those f*cks away from each other! Or at least put the violent assholes in with the violent assholes and keep the non-violent guys safe so they don't become forced to be violent guys themselves.

No, the real reason is authoritarian f*cktstains get a huge woody thinking of little Johnny Pothead's anus getting reamed out by Bubba.

And in many cases Bubba was just a guy who made a mistake until he himself got raped and beaten until he became a monster.

It has to stop.

Good. Men have a whole 'nother set of issue when it comes to this, the first of which is the additional social stigma of it. If you are a straight man, well, you just are not supposed to be victimized like that, and if you are a gay man according to the LAPD:

...gay men can't be raped (new window)

It's hard for anyone to face and process and make a life afterwards, but men do have more pressures in processing it in our society. Making statements like this are important for boys and men who have lived though horrific abuse to work toward dealing with it and moving forward.

I'd pull out the not sure if serious pic but on the off chance you honestly believe that I guess it needs to be pointed out that is in fact possible to be wrongfully convincted. We have plenty of stories reported regularly on Fark of police and prosecutors who railroad innocent people into jail for one reason or another.

RminusQ: Coming to your headlines in twelve months: Under the Obama administration, the FBI reported that rape was up by 8 billion percent.

Happened when the NCVS (now the NCS) changed the way it asked women about being raped. Rape went up 40% in a year, and the Feds had to explain to non-scientists that no, it wasn't a new rape epidemic, they were just measuring it more effectively.

Besides, it won't go up much. The vast majority of rapes of males go unreported, mainly due to 1) the stigma of homosexual rape in this culture and 2) the pervasive sexual double-standard that says that a man can't be raped by a woman.

Lucky LaRue: Wait. Forced anal sex wasn't "rape rape" until now?

Probably considered aggravated sexual battery in the statistics.

I think this is just about making federal statistics and reporting match up with the state definitions of those crimes:

The administration said this expansive definition more accurately tracks rapes but will not change state or federal laws used to prosecute rape, most of which already incorporate the more expansive definitions, NBC reported Friday..

This Administration thinks IT MAKES THE LAWS!! He thinks he is a KING!

Butt that said it was needed but maybe he should let congress pass the laws LIKE THE LAW (constitution) says.

This comes about a year after the Republicans tried to limit the definition of rape.
