I wonder if Stewart will comment on this too. His 'both sides are equally bad' bit last night was pretty stupid, but touched on this point as a reason Obama shouldn't have done the appointment - that Congress was supposedly in session.

I.5.4 Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting.

It's stupid, but it's in there, because our founding fathers (praise be upon them) never dreamed off the level of asshattery we have today.

The House has not agreed to a continuing resolution to go into recess to allow the Senate to not be in session. Pursuant to Article I, Section V of the Constitution, the House is holding these 30 second sessions in order to prevent the Senate from going into Recess.

Basically, the House can force the Senate to not go into Recess, which is why the Senate is holding defacto sessions every day. If I was Harry Reid, I'd get all my Senators back to Washington and force the Republicans back into session and bring forth a legislative agenda the likes of which the have never before seen.
