I think you nailed it. So this guy stopped a child molester, a would-be murderer and an actual murderer? I'm surprised his lawyer couldn't get a "heat of passion" claim and get the charges down further or dismissed.

Here I was, all ready to call this obvious self-defense, but from TFA it looks like the threat had in fact been adequately neutralized well before the trigger was pulled. That makes this an execution, not self-defense, and thus an inappropriate killing. I do think there's a clear case for mitigation, as even the DA points out, and this seems to have been applied in the plea bargain.

Bottom line: I'm not sure I see a problem here.

No, actually; this particular man shouldn't have done it, but your son did in fact deserve to have his entire future taken from him, and frankly with far more brutality than he seems to have gotten. Where was that "piece of your heart" when you failed to teach your son not to rape little boys?

Manslaughter is better than murder 2. I am not saying your theory is impossible, but very unlikely. Heat of passion usually does not get used with manslaughter. My guess is the negotiations started at murder 2 with heat of passion (~ 20 years) and then they settled on manslaughter where he was given 12 but will only serve 6. If was the DA I would decline to prosecute and let them fight it out in civil court. If the mommy of the child molester wants justice for her snowflake she can pay for it to happen.

Sounds right. I had to draw a little flow chart while reading this story though. Example: The boy reported that Kubiak told him about the apartment incident and that he feared for the boy's safety.

I'd definitely argue that the guy was in a fit of rage. I mean... The thought of my child or one of my friend's children coming to me with that information? That, combined with my lack of understanding of firearms, would create the exact same situation. I'd have shot 18 times too, because I was enraged and because I wasn't sure the farker was dead.

Vigilante justice is bad, but real justice has fallen short on child rape on several occasions. I just can't bring myself to feel that this guy did something wrong.

Interesting -- because it wasn't like this guy was just downloading the pictures. He was actually diddling the kid. Which in my opinion he got exactly what he deserved.

I don't have kids - but if I did I could easily see going to any extreme to make sure someone who molested my child would pay. Just imagine the rate of molestation and how it would drop if pedophiles knew they would be quickly killed for doing what they did.

I will say that unless the gun owner had VERY specialized permits, the AR-15 was not a full auto rifle.

Sounds to me like the best chance this guy has is to get a jury trial - as long as there is one juror that has a child, he's pretty safe.

AR-15s typically come with 20 and 30 round magazines. If it was a 20 round magazine, he definitely ran out of ammo since the ephebo had already fired it before he got there. If it was a 30 round magazine, it's more of a toss up since we don't know how many rounds ephebo fired at the kid's dad. If Kubiak didn't run out of ammo, he should be chastised for it.

I always wonder what would happen if someone breaks into our house. I train regularly with our hand gun and am naturally a pretty good shot. However, I also train to empty the clip. The castle laws in Montana are pretty strong, but I wonder what people would think if they walked into our house to see a guy dead on the floor with ten rounds in him.

Since I'm a woman though, I bet it would be classified as self-defense with no jail time.

You're confused, but that's understandable, since the writer of the FA can barely write at all. It was Brignoli, not Kubiak, who fired the stray bullet. FTFA:

"Brignoli went to the Palm Harbor apartment complex where the boy's father lived and fired multiple rounds from an assault rifle in the parking lot.

An errant bullet struck resident Jim Freeman in the face. Freeman, who did not know Brignoli, died about a week later from an accidental overdose of pain medication."

The key is to shoot him in such a way that he is upright the whole time. Then you can say he was still comming at you.

When you shoot him once he is down, that's when it becomes murder.

Those of you calling the shooter a "hero" and urging that he should walk, did you read all the way to the end? He wasn't exactly an angel himself.

FTFA: "At the time of his arrest, Kubiak was barred from the family home because of violent outbursts, she said. Kubiak was arrested at age 13 when he vandalized a school. He spent much of his youth in and out of juvenile detention facilities, Amy Kubiak said. As an adult, he was arrested on charges of disorderly conduct, battery on a law enforcement officer and carrying a concealed weapon."

Brignoli is dead, and that's a very good thing. And Kubiak is in prison before he kills somebody less deserving than Brignoli, which is also a good thing. If it were up to me I'd give him a handshake, a medal, and LWPOP.

Never has the phrase "and nothing of value was lost" been more appropriate.
