The defendant was under attack from the first punch to the back of his head until he stabbed Dylan Nuno.

Hard to get all sympathetic with somebody who punches people in the back of the head.

The judge found that Saavedra, who was 14 at the time and a year behind Nuno in school, was consistently picked on by Nuno and his friends and had "more than enough reason to believe he was in danger of death or great bodily harm" and that he was "legally entitled to meet force with force, even deadly force."

Whew. Still rockin.

To be fair, it's quite possibly the fault of the parents that the kid became a bully.

I should clarify I'm not glad the bully is dead, but I am glad the kid didn't get punished for defending himself like all that zero tolerance horse shiat that penalizes the bullied.

Good. Finally a law that makes sense.

Now to end all the "zero tolerance" nonsense inside of schools. In nearly every conflict situation inside a school there is a bully and a victim - they should not be punished equally. In North Carolina, we have some absurd examples where victims of sexual assault inside a school defending themselves received the same suspension as the person assaulting them.

Probably not as many as you think. Gang members, for example, have already tried to use the "stand your ground" defense in Florida, and it never flies. A key component of the defense is that you can't be otherwise breaking the law when you kill somebody.

Also, multiple hearings for this case were held. Other students with no particular interest in either side confirmed that the kid with the knife had been trying to get away, and the kid who got stabbed, along with his friends, had pursued the younger boy and attacked him.

So no, you can't just pick a fight with someone and use it as an excuse to kill them.

If I can compare this to the Wal-Mart pepper spraying, it seems that the one thing that won't easily get you in trouble in this country is defending yourself against a bodily threat; serious or subtle.

Never happen. Why? Because kids of parents like that don't become bullies. They may try, however when they bully someone and their parents find out, their parents punish them. They will be made to understand that it is not ok behaviour.

Bullies are always from parents of one of three kinds:

1) The parents that just don't give a fark. They are just uncaring, or on drugs, or in jail, or whatever. They take no interest in their kids' lives and as such the kid can act out as they please.

2) The parents that deceive themselves. They believe their kids are perfect angels, against all evidence. When anything happens it is always "Oh my kid would never do that! The other kid must have provoked him!" The kids can bully because they parents always back them up on it, believing that it couldn't be their kid.

3) The parents themselves are bullies. They believe bullying is a good thing, if you are stronger yo can do it, and support their kid for "Not being a pansy," and shiat like that.


Hence, when this shiat happens, the parents never say "Ya he had ti coming," because if they believed that and cared, they would have intervened.

So many conflicting emotions. I was bullied mercilessly and really do wish painful deaths upon my former tormentors, but I'm also mostly a pacifist and don't really like violence.
Fark it, I'm glad this bully is dead. The guy with the knife might have saved a good person from committing suicide as a result of the bully's actions.

I saw fights (and even bullying) when I was growing up and no one got stabbed.

Frankly, if you're carrying around and knife and you kill someone you should get premeditated murder. (the act of carrying the knife is the premeditation). In a sane world or state this is what would happen.

You fight back against a bully with either words or fists, not a farking DEADLY WEAPON!

This nimrod geek should be in juvie for life.

Er, my grandfather got out of very similar circumstances in Florida almost 80 years ago. "Unintended circumstances" my ass, the ruling just puts things back where they were before. They just seem more contextually out of place in a society where we try to rehabilitate, something I do agree with in principle. Unfortunately that only works if people choose to bottom out and get fed up before punching others in the brain stem; you kind of can't go back after that.

Maybe instead of letting things get out of control to the point where someone gets killed, we should first acknowledge that bullying is not acceptable behavior and will be corrected.

You know, so that when the kid goes to their teacher or principal etc and says someone's being mean to them, the teacher or principal will recognize that this is a valid request for help and that their involvement is indicated.

As an added bonus, kids with problems can be helped, and the unhelpable can be identified (if not for institutionalization then at least as background to any future crimes).

In a perfect world, I can only hope that this makes thousands of bullies rethink their actions and choose a better path. I know we're not in a perfect world, but I can at least hope.

Good to see that at least the courts saw that this kid was getting hounded on a continual basis, was ambushed in a public place and was entitled to protect his own life.

Do you believe also that individuals who use a legally carried concealed firearm to defend themselves, with deadly force, against an unprovoked aggressor should also be charged with "premeditated murder"? Is a willingness to use deadly force in defense against a violent aggressor premeditation in any legal jurisdiction?
