This could be accomplished through an "orange-distance filter," which would capture the "likely presence" of a human face in front of a camera. This filter would also be used to detect a person's skin tone, and measure the distance of their face from the camera.

I smell a Jersey Shore endorsement deal

How many iPhones and iPads are shared devices that actually makes seeking this worthwhile? Why couldn't a biometric print reader not accomplish the same thing? How will it differentiate between a photo and the real deal?

And not only that, what if your name is Werner Brandes, and your photo is your passport?

This has been discussed plenty before; I'm surprised there's not already a half dozen patents for this. Saying that making it for a mobile device is what makes it innovative and unique is the tech patent equivalent of adding "in bed" to the end of hymnal song titles.

My Lenovo netbook running Windows XP can do that. It has a little webcam on it, and you can set it up so that it will do facial recognition, log you in to your account with your settings, and decrypt your files for you.

It was bought on clearance 2 1/2 years ago, so that sounds like prior art.

Fairly sure the Galaxy Nexus has Face Unlocking, which I'm pretty sure is prior art and would invalidate this.

This is sort of different, ICS does full biometric for unlocking. This patent covers simpler biometric running all the time so you can pass your iThing to your wife and then bam instantly it loads her settings. This shouldn't prevent android from applying settings on unlock for multiple users, but hey Apple will probably sue anyways.
