They are not facing criminal charges for the oil spill. They are facing criminal charges for false statements in the permitting process.

If it includes the BP company man on Deepwater Horizon, I applaud this. That is the person that is most responsible for this. Any officials that pushed against obvious safety problems should as well. If the Company man had done the right things and BP ran him off, as Company men are 3rd party Contractors, he would have been picked up by Shell or Chevron. Safety in the Gulf isn't lip service industry wide.

Well, in the case of the Union Carbide accident, the whole reason there was an accident was really that no one was responsible for safety oversight, it had been handed to the local guys who weren't half competent, apparently. So there not being anyone to prosecute was kind of inherent in the issue. Stupid, yes, criminal, not really. Given that the whole city has chronic lung issues now, monetary compensation is more helpful, to boot.
Love canal probably should have sent some inspectors and zoning people in for a few months, though.

India wanted to put Americans in jail for Bhopal but they left the country to avoid prosecution. According to WIkipedia some Indian nationals were convicted last year but will not serve time.

If these guys had listened to their consciences (assuming) and been whistleblowers, they'd have amnesty and receive millions from the ensuing lawsuits.
They're clearly too dumb to be mid-level managers at a major corporation, anyway.

If the accident didn't happen they would be out of work, blackballed from future work, and sued by their previous employer for any wrongdoings in the first place.

The Department of Justice still could decide not to bring charges against the individuals, people familiar with the situation said. It's not unusual for prosecutors to use the threat of charges to pressure people to cooperate in investigations.
Also, its engineers and a single manager that are targeted, not a bunch of midlevel managers
