I think they can do that because the cheesehead doesn't say "Green Bay" or "Packers" on it anywhere. It is just a chunk of foam(?) molded to look like (swiss to me) cheese and painted yellow. Put a team name or logo on it, then it is copyright infringement. I think, IANAL.
