Batavia resident Jacquetta Simmons, 26, was charged with two counts of second-degree assault, State Police Trooper Tracy Patterson said. She faces a second count because the victim, Grace Suozzi, 70, is older than 65.

I didn't know people were charged extra if their victim was older than 65. I'm not sure how I feel about this.

I don't understand why people wouldn't take the slight action of just showing their receipt to the person working the door. Why do they have to be all "THEY HAVE NO RIGHT!" and create a pain in the ass for the retail worker who probably already hates their job? Write a letter to management or something if you feel that strongly about it. Otherwise, take the 2 seconds to show your receipt. It's not that big a deal.

I think it was Nick Swardson who said that the elderly should be allowed to drive their age. If you're 90, you should be able to drive 90 mph.

If I thought old people should be allowed to drive, I'd like that idea.

Oh, please don't misunderstand me; I don't get that either. I don't have a problem with it and, if asked, always show my receipt. I'm just seriously questioning whether the "I don't show my receipt on principle" types have actually utilized such a hyperbolic defense.

Because it's not two seconds. It's stand in a line like a dumbass, waiting for some guy to check my receipt. Why should I stand in a line for a service that I don't need in any way?

If there's no line, sometimes I agree, sometimes I don't feel like it. Either way, I doubt the drone has much personally invested in looking at my crap. It's not like me agreeing to show them what I bought just makes their day. In skipping the process, I'm saving them work; if anything, they should be happy.

Since you don't read many threads, how about spending 30 seconds or so Googling it? Should have dozens of examples of it then since you missed them the first time around. I assume you know that many stores have a legal right to check it, so use those as a jumping off point for your Google query.

Not trying to be disrespectful, but what is the legal basis for their not having the right to check your receipt? Is it a federal law? State law? Local laws? I have read a LOT of online articles about people pushing this point and they all say, "They do not have the right," but they never say anything beyond that. The only thing that I have been able to ascertain for certain is that this is NOT a 4th Amendment issue as the 4th only applies to the government. So, what is the legal basis for this?

Again, I am not trying to be disrespectful or rude or anything like that. I am really curious about this. Thank you.

I doubt it's ever gotten that far.

In my mind though, I gave them money, they gave me items and a receipt agreeing to the whole thing. The items (and receipt) are mine now. They don't become mine later, when I leave the store or something; so what would even give them the right to examine what I now own?

As someone else mentioned, it works different at weird stores like Costco, where you agree beforehand to get your receipt checked (when you sign up for the membership that lets you shop there).

Not that I shop at WalMart in the first place (I refuse to, for a number of reasons), but like others have said, receipt checks aren't worth worrying about as long as there isn't a line. If there's a line, then fine, skip it...but if there isn't, then let the greeter have their little ten second power trip and move on with your life. Ten seconds isn't worth worrying about.

I am asking about this because the guards at my local Home Depot are a bunch of pricks and am considering pushing this. If I do, though, I want to be able to be very specific when I tell them that they do not have the right to demand to see my receipt.
