Charlie White is ineligible to serve as Secretary of State and should be replaced by Democrat Vop Osili, the second-highest vote-getter in the November 2010 election, a Marion County judge ruled today

It will also be interesting to see if the pressure increases for White to step down and if Mitch Daniels will try to appoint his own replacement before Vop can get sworn.


Not that I wouldn't be suprised to see someone try to pull this, but if Daniels puts somebody new in the office, wouldn't the judge just toss that guy out on his ass as well?

Not that I'm in any way, shape or form defending him, but if his trial hasn't started yet, how can he already be deemed ineligible on account of being a felon? Is registering in the wrong district not one of the charges he's going on trial for, or did he already plead guilty to that? Or is he ineligible because it was an election rules violation, not actually because he's a convicted felon (yet).

Even more fun: since, per Indiana law, automatic ballot access is restricted to parties getting 2% or more of the vote in the Secretary of State race ^ , there's now controversy over whether the Republican party will automatically be on Indiana ballots from now until 2016. After all, if Republicans didn't run a legal candidate, they can't legally have gotten any votes, much less 2%.

/always votes Libertarian for Sec State, just to keep the third party in the mix

The WI GOP (a.k.a. the Koch Brothers party) solved that problem by sending out fake absentee ballots directing voters to send them to a private PO box instead of their polling place, two days after the election. All in the name of stopping voter fraud, of course.

Well, it is voter fraud if he voted in the district he was illegally running in. That's pretty likely because every politician loves to have the local media photograph them casting their ballot for themselves, for whatever reason.

We had the same problem with a Republican in WI. Randy Hopper was up for recall, and when petition circulators showed up at his house to tell him he sucks, his wife told them he was busy living with his mistress in another county, a clear violation of the law. Then his wife and their housekeeper both signed the petition against him.

Last I heard about "Bed-" Hopper, he got a DUI after he was booted from office, swerving all over the road drunk as Hell with his mistress in the passenger seat, and was looking at losing his license - preventing him from being able to vote because of the voter ID law his own party pushed through.

Well, to be fair those were applications to receive absentee ballots, you know. No room for error there whatsoever! You send in the application, you receive an absentee ballot back that you send to the county election board. No problem! I mean, if some things just happen to get lost in the mail...well, that's what you get for trusting in a federal Obama government office, socialist.

And the election date thing was just an unfortunate, unfortunate typo. And since the election date is so well publicized anyways, there's no real point to making bones about it is there!

If the Republican party is smart (in a political sense), they'll just go through the formal process of getting on the ballot next time around to remove any legal questions on the subject. Although to be honest I doubt it'll be considered a serious issue.

That said, I'd lay money on them, instead of owning up to having Seriously Farked Up, start screeching on a national scale, replete with "why does Indiana hate common sense conservatives? They even voted for 0bummer in 2008!" crap on Fox News, and eventually force the state to back down and (illegally) automatically put them on the ballot anyway by prosecuting them in the court of public (stupid) opinion.

That is if anyone at all makes political hay about this, and the Indiana state government's politically competent and willful enough to faithfully execute the law. It's vastly more likely the state government, populated by conservatives as it is, conveniently overlooks this whole mess in terms of faithful execution of the law. Then, if the democrats -- not that they're any better in this damn state, it's only through gritted teeth and hateful exhortation toward whatever higher power may actually exist that I throw my anti-Republican protest vote their way -- make noise about it, cue aforementioned screeching and wailing.
