I watched the video.

The lady put something back through the drive-thru window. Then she put something back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. Then she put something else back through the drive-thru window. HOLY FARK, how much junk food did that angry land whale buy and then put back through the window?!

You're basically suggesting that it should be legal to harrass people and throw things at them as long as you don't cause significant physical harm.

That's ridiculous. Laws regarding simple battery were created a long time ago to deal with situations like this, where someone has been physically abused without significant ham being inflicted.

I'm pretty sure ham was being inflicted. Look at the youtube. I swear I saw some sausage patties there.

CheekyMonkey: Wise_Guy: ReapTheChaos: Ill be honest though, getting your order farked up can really piss you off. I've never thrown an order through the window but I've gotten home, realized it was farked up and threw it across the room. I did that one time and took it back to the place, they looked in the bag and asked "what happened to it?" I calmly said I threw it at the wall, what of it?

You do know you're an idiot, right?

Why is he an idiot? This is perfectly reasonable behavior. Why, just the other day, I was having dinner at Gramercy Tavern, and the waitress brought me sweetbreads instead of the steamed mussels I had ordered. You better believe I threw that shiat back at her. How else is she going to get it right?

\oh, wait. No, I didn't do anything of the sort.
\\the gene pool would be dramatically improved if everyone at McDonalds died of food poisoning

I never said I threw it at anyone. I got home, realized they gave me the wrong order and threw it at the wall. Huge difference. (I was actually throwing it toward the trash can and hit the wall instead.) You mean to tell me you've never thrown anything when you were stressed out and angry? I would find that a little hard to believe.

Not exactly a refund CSB, but here goes:

I was working the front desk at the local bowling alley on a Saturday afternoon. Family of 5 comes in. The dad goes to the snack bar counter, while the mom gets shoes for all of them. Policy states we collect pay for shoe rental up front, games get paid after. So, since the dad isn't there, mom hands over a credit card, and as she's signing the receipt, dad comes up all flustered saying she should have waited for him and paid with cash. He asked for lanes all the way at the end of the house so they could be away from everyone. Ok, whatever, I gave them that.

Fast forward a few hours. The place has been busy and I don't notice that the family is nowhere to be seen. I go down to their lanes and the bowling shoes have been left. A tell-tale sign that the group walked out without paying. So I tell the manager. We at first start to write it off, but then I remembered them paying for shoes with a credit card. Go back into the receipts and get the one from that transaction. From that we go into the credit card machine and get the number and are able to punch it in and charge the ~$120 in bowling they walked out on. Problem solved, and no complaint was ever filed that I know of.

Katolu: Why does her profession matter? If it were a bank teller or mail room guy would it matter?

You may have not noticed it but many people have an agenda against public schools. If the only teachers you see in the news are crazy/stupid/sex-perverts then you may not feel good about your taxes paying their salary.

Some may see such news as just making fun of teachers while others regard demonizing public teachers as a step toward abolishing tax supported education. If you are rich enough to buy your kids a good private education then why should you also pay to educate low class kids where it is probably wasted?

If only they could fire the bad teachers, then maybe we could stand behind the public school system.

So you feel whenever a teacher behaves badly it is good to report in the news their occupation and demonize all teachers because they are in a conspiracy to protect bad teachers? As opposed to being a selfish jerk that doesn't want to pay for public education?

While I enjoy your pun, I think that saying something should not be prosecuted is different from saying that thing should be made legal.

We don't have infinite resources to prosecute every crime.
And for the most part, we don't want a government that prosecutes every crime we commit. (see "Three Felonies a Day: How the Feds Target the Innocent ")

So no, I do not want a prosecutor prosecuting any citizen over a stupid argument who most egregious outrage was the throwing of a pancake.

But I suspect you know that and just wanted to make the ham pun.

Which I did appreciate. I never sausage a pun being made.

Not really much in the way of battery there IMHO. Maybe a drink and a pancake hit him. Owie!

You have to wonder what led up to this. What could possibly anger someone so much that they flip out and start throwing/placing food back through the window? It's sad really.

Thinking back to my McDonald's days in high school, 95% of the time employees don't give a fark. The mindset being- if you want us to give a fark about stupid stuff, then pay us more than minimum wage. For simple things like, "You forgot to give us the 3rd french fry" when it was busy, I'd just give it to them even if it wasn't on the bill if they were being genuine/friendly about it. The one thing that would piss me off would be the rare person trying to scam something. Like the lady who returned a half-eaten sausage mcmuffin 30 minutes later saying it wasn't made right (yes it was) and demanding a double quarter-pounder instead since it was now lunch time. For fark's sake, THAT IS BATTERY PEOPLE: http://legal-dictionary.thefreedictionary.com/battery

"Battery is both a tort and a crime. Its essential element, harmful or offensive contact, is the same in both areas of the law."

The only legal requirement for something to be called battery is "Harmful or offensive contact". This can be someone touch someone offensively or throwing something (Like an orange juice and a pancake) at them.

Learn the definitions of words before you use them.

Zizzowop: I was working as the manager of a truck accessory store where a customer called the police on me because I wouldn't give her a cash refund on a canceled order. I couldn't because the store didn't have $900 plus in cash on hand for me to give her. I told her I had to get a check sent to her. She did a head bob in a circle, and said, 'hells no, I want cash money, I'm callin the poleese!!' Before the cops showed up, my manager at the corporate store(I was in the process of calling him after she refused to wait for a check) said the customer paid for previous items with a Visa card, just credit her the money-however she wouldn't talk to me any more until the police arrived. The cops showed up, I explained what was going on, and she accepted a credit to her card. If she had been rational, I could have taken care of the problem without bothering the po-po, but she wasn't and had to get the police involved. I'm not a racist pig, but she wasn't white. Cops stayed to shop for accessories, which was just a bonus.

Usually when a person pays with a card and then demands a cash refund, it's a stolen card. Surprised she called the police.

Straight from Florida law:

784.03Battery; felony battery.-
(1)(a)The offense of battery occurs when a person:
1.Actually and intentionally touches or strikes another person against the will of the other; or
2.Intentionally causes bodily harm to another person.
(b)Except as provided in subsection (2), a person who commits battery commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

And yes, that includes throwing things. What's hard to understand?

idk... It looked like the guy just kind of let that food fall off the windowsill onto his feet because he was busy making his phone call to either his manager or to police (donno which).

Either way, that's the lamest example of battery I've seen result in an arrest. And I certainly didn't see anything close to the described battery: "striking the attendant in the face and chest."

If that's the entire incident, she yelled and dropped the food on the floor. He probably got some of the drink on his feet. Cry me a river, police have more important things to worry about.

There he is... looking at his shoes after she drops a drink on the floor.
