if the employee handbook states something along the lines of "an employee will be terminated for bringing weapons onto company property" (as has been written in several of the handbooks for companies i've been worked at in california), aren't you essentially fired once you cross the property line?

I do feel for the mother. She relied on her son to help her pay the bills. Also, her son very likely was farked up because of work. She should get some benefits from the place. Also, I think her quote about people out there who have a responsibility because of workplace problems is right.

Technically, you're entitled to workers' comp regardless of whether your injuries were self-inflicted or otherwise your fault.

Can't speak for MO, but in NY as a former WC adjuster I would deny this claim, primarily for the reason that the injuries did not occur in the course and scope of employment. Unless of course he was hired to be a psychopathic gunman, in which case I think I'd have to accept the claim (and promptly ask underwriting why the hell we insured this company and hope they paid a lot in premiums...)

Of course I would also deny on the basis that the injuries did not occur at work, or along a route of travel designated by the employer as being work related (again, unless he was supposed to drive down to the PSB and lob bullets at cops...)

Sorry, being grumpy because of work is reasonable. Killing people because of work is not. If you're shooting people because work pisses you off, you had serious issues outside of the workplace.

I have an idea. Since the gunman's mother is saying essentially "work stressed him out so much that he went crazy and can't be held responsible for his actions", how about everyone else at the company just says exactly the same thing? Now they're not responsible for failing to intervene, because they're crazy too. Cool, everyone's absolved!

Except it doesn't work. You're only absolved of all responsibility if you're crazy enough to kill. There's no payoff in being slightly crazy.

doccm9: The "Bad Kitty" can be circumvented by putting a #1 (or similar code) to the end of a URL. I understand perfectly that some just get multiple submissions, but other times its blindingly obvious. Like a few days ago when the one I submitted had a bit of misinformation in the title just to add a joke, it was not accepted, and 30 minutes later or so another version was accepted using my joke version as fact.

Finals start in two weeks, getting stressed. That's all.

Guys most insurance policies through your employer state that benefits are not covered if you were performing an illegal act or the injury was self inflected. Which in his case both of these should apply (Walking into a police station with guns a blazing is asking to be shot)

The workers comp should have the same rules in place. Also the state review of any denied work comp claim by your employer for any reason is generally mandated by state law.

A friend of mine who's a cop tells the following story, which I've also personally confirmed with the judge involved:

After the third time my friend arrested this fellow for attempting to sell him (my friend) drugs, he went in front of the judge and claimed it was entrapment. When the judge asked him how he comes to that conclusion, he said "well, your honor, I knew he was a cop", to which the judge replied "son, that's not entrapment; that's stupidity".

Most of you people are hacking on a woman who simply wants to see if she is entitled to benefits of her sons death. I think that she is a money grubbing biatch like the rest of you, but she is being a realist. If you can get the money, then do it. You still gotta eat regardless whether your son is alive or not.

And on another note, I don't know where you people work, but where I work it is just a matter of time before someone brings in a gun and shoots the place up. Management is arrogent and elitist and they don't care about union rules, so they violate them at their convienience. There are no penalties enforced on management so they do as they please. The company's name you ask? U.S. Govt. Nuff said
