Might want to read this followup article, submitter. Strict eavesdropping law ruled unconstitutional in Illinois case (new window)

I like when lawmakers who know nothing about the Constitution pass laws like these. The gape-mouthed, near-drooling look on their faces as their precious piece of legislation is struck down and spat upon really has a way of bringing out their inner-imbecile, and they remind me of that Shane guy from "The Walking Dead" who always looks like he just walked in on a roomful of nuns ass-raping a goat.

You don't know if they're going to learn something or if they're just going to shoot you in the face for being smarter than they are.

I was going to post this in the Blues Brothers thread, glad I saved it,..

FTFY, unless you are implying they had strap-ons or something. Then, THAT'S HOT!

Well yeah, because you're raping the cop with your camera!

You're free to get your ass kicked by the cops. It's in the constitution.

2011-12-02 09:41:11 AM
One of the things they tended to do was arrest people for violating the law, and then drop the charges before trial. If there's no trial, the courts won't be able to overturn the law.

If the Supreme Court ruled a person has no expectation of privacy when in public, then I want to know how the hell public employees, such as police, paid by the public, working in public, have more of an expectation of privacy.

carrierx: dont record police then ?

Why should I be afraid of the people whom I pay to protect and serve me?

Why should I not be permitted to record the behavior of the people whom I pay?

If my boss can install hidden cameras in my work facility and a keylogger on my computer to make sure I'm doing my job, why should I not be allowed to openly use a camera in a police officer's "office"?

One would think most cops would like cameras around, since their actions are usually justified but misrepresented by the people around them and cause undo consternation when statements conflict. The camera does not lie.

Bathia_Mapes: Might want to read this followup article, submitter. Strict eavesdropping law ruled unconstitutional in Illinois case (new window)

Good find, that. Here's the part that needs to be trumpeted:

"A statute intended to prevent unwarranted intrusions into a citizen's privacy cannot be used as a shield for public officials who cannot assert a comparable right of privacy in their public duties,"

Your article mentions however that the law is still in effect. Which is to say, it will still be misapplied.

Because the police aren't your employees.

You're paying them protection money.

And for the love of god, don't be a member of the press that uses a video camera or a stills camera. Also, don't be a documentary filmmaker that accidentally records a cop. And, never take pics of your family in public unless you're sure there's no representatives of the government around.

Yeah, they'll continue to charge people, and the people will have to spend tens of thousands of dollars fighting their way through courts of appeal.

Pretty much this. When I did that job I wanted the camera on me because I know I'm not doing anything wrong. But if I do, especially if that something wrong gets me killed, the organization will have a video they can show to current and future members so they won't repeat my mistake. That's how people get better at stuff: They see things done wrong and say "Hm, I shouldn't do that."

fark the police. This is why I just shrug when I hear on the news that one of them was injured or killed in the line of duty. No different than any other hired thugs, these just work to generate revenue for the city instead of some less official organized crime syndicate. Want me to respect you and stop thinking you're all just thugs? THEN STOP ACTING LIKE THUGS! And don't give me that crap about a few bad apples, from what I've seen most of the apples are bad, since they all protect the worst ones from any consequences.

Absolutely; though considering it is at the public-awareness level of "solved within 10 posts" on Fark, we might be at the point where citizens will be able to avoid even getting booked when they remind the sergeant at the precinct that such laws have already been crushed by the courts all over the place, much to the embarrassment of the police. At the very least, the local magistrates will be aware of it.

Hey, a guy can dream, can't he? Also, my phone doesn't do video so I probably won't end up even close to such a false accusation.

Small point, Subby-It was a Judge that brought charges. The others were added upon discovery.

I wonder if anyone is willing to take this to SCOTUS for final resolution? Like said earlier, this law will be misapplied again.

Can somebody please f* these a) prosecutors and b) cops in the a*? But mostly the prosecutors... someone needs to make an example of them.

This kind of shiat is what all these uppity budding loy-yawhs should be up in arms about; too bad so few actually involve themselves in shiat that matters but rather insurance litigation and other $$$shiat.

Just put up a little sticker that says "Audio and video recording is in effect on this property." Both parties now have knowledge of the recording and no side has an expectation of privacy.

/downside is you can never leave your property or the fuzz will beat the shiat out of you

While I disagree with most of your statement, I do feel there are 2 kinds of people who become cops: the ones who want the job for the ability to carry a gun and badge so they can bully people, and the overly idealistic idiots who think they're making the world a better place. I suppose I should add disillusioned people who used to be in the second category...they're the worst of all of 'em=P

The authorities will drop the charges before it gets that far. That way they can misuse the law again and again and again, and only cave in when they try to apply it to someone that can afford $100k in legal fees.

I always thought the whole recording of another person was considered illegal if the party being recorded had no knowledge of it or didn't give their consent. But going back to Bathia's post, the guy asked for a court reporter at the initial appearance. I thought court reporters were there for all proceedings, felony, misdemeanor, civil, or otherwise.

Doesn't stop him from being a tremendous piece of shiat. He is a fascist. The only reason he's on the right side of this is that the Democratic administration of IL is on the wrong side of this one and he's being a contrarian.

So, when the Police Precision Motorcycle team comes rolling down the parade route, everyone has to turn off their cameras, right?

2011-12-02 10:19:32 AM
taping the cops carries the same sentence as rape ... you say? It's just a nascent thought, but in Afghanistan women are expected to marry their rapists. Maybe there's an idea in here somewhere for a movie? I don't have time to think this through right now, so I've already mailed this post back to myself to protect against infringement. It's early yet, and I've still got everywhere else to get to on the internet before lunch today ... bye!!

Every police officer in the United States needs a shoulder mounted video camera, recording from the moment they leave the station. The very first lawsuit that one of these cameras dismisses will pay for the cameras in saved legal fees. An officer who doesn't want his actions recorded is trying to hide his behavior, something that an officer of the law is not entitled to.

Some cops are good cops. A.d its sad when a good one falls in the line of duty. I know a family who were a sheriff family. All the men served in the sheriffs office. Good family. But the son was murdered by a thug for no damn reason other then he was a cop. The force lost a good man that day.

But what I read usually is most cops are bad. So its even worse when we loose a good one.
