You can spin the comment as out of context and not actually throwing his client under the bus. It would still be a damn-fool thing that a competent defense attorney would not say -- would it would not be as bad.

But that would ignore the fact that this is not a competent defense attorney. This is an attorney who put his client on the phone with Bob Costas for a disastrous interview that will be exhibit 1 in any prosecution, while he sat by and acted creepy. His comments this time should be read in the context of his entire course of conduct, which appears, quite frankly, to be conduct of a freak using the opportunity to promote sex with younguns.

As hell-bent as Sandusky seems to be on convicting himself, he's still innocent in the view of the law until proven or pled guilty, and thus he has the right to a defense. That said, his lawyer is proving to be a tool, and I wonder if Amendola is the only private defense attorney willing to take the case. Right now, it appears Sandusky would have been better off asking for a public defender, or just pleading guilty and begging for segregation.

Sandusky's strategy:

(1) Get convicted.
(2) Appeal on grounds of ineffective assistance of counsel.
(3) Stay sentencing pending appeal.
(4) Overturn conviction.
(5) New trial.
(6) Repeat as necessary for whatever is left of his pathetic life.

Ta-da!

/a little bit analogous to what I tell my clients as a tax lawyer: "have a shiatty business, make bad investments and that way you won't have to pay much tax."

personally i like their extended coverage and detailed analysis of flag football this morning...what the fark was that shiat?

joepa and penn state are probably raising money as we speak to pay sandusky off so that he will go the fark away and not reveal just how much penn state and joepa knew and how long ago they knew.

Story behind the handle: was a fan of an NBA team called the Super Sonics, back before the NBA sucked. Some friends and I called them the "Chronics" when they underachieved, mostly based on an Ice Cube song mentioning the team, I think (rhyming it with the term for marijuana, of course. So, only indirectly pot related; I didn't even think of it that way... I thought of it more like "this team is a bunch of chronic underachievers." I should probably think about changing the name. Especially since the NBA sucks.

This is not to say I never partook of the green stuff.

We have an adversarial system. As a result, he must be afforded the right to defend himself.

1. He isn't guilty until he either pleads guilty or is found guilty.
2. No matter your crime, if we do not follow our own laws with respect to our justice system then the entire system is a sham. You can't be a nation of laws and arbitrarily choose not to follow those laws.
3. Since we are a nation on law, he must have a defence. If we do not provide him a defence then he can not be found guilty. No lawyer = he goes free.

4. Even if he were to admit his guilt to the lawyer, and planned to plead guilty, the lawyer has the moral responsibility to represent his client and ensure that his rights are protected.

Number 4 is important because should(must) only seek punishment that is codified and Constitutional. To intentionally do anything in excess of what is legally prescribed is a heinous violation committed against our society.

The concept that someone would seek extrajudicial punishment is disgusting. The type of people who would do such things are dangerously close to being little better than animals for they abandon reason by committing an act that by definition places them outside of civil society.

Maybe that was too much...

The simple answer to how you defend someone you find to be disturbing? You ensure that they are afforded a fair trial and due process.

Why do you end up having to defend them even when you don't like them? Because the system is adversarial. The concept is that if both sides fight hard and fair, the correct decision will have been reached.

So you defend, because if what the prosecution says is true, then the expectation is that the prosecution will win. If they lose, then in the eyes of society, the man was NOT guilty.

I'm not an advocate for suicide. Far from it, I find every life inherently valuable, but when something like this happens, and people know its happening, to the people who have knowledge of it and did nothing, well I don't know how you could wake up on the morning and look at yourself in the mirror and not slit your wrists.

Remember folks, the purpose of a defense lawyer is not to have their client found not guilty. Their purpose is to fully explain the legal process so that the accused knows what exactly s/he is accused of, what penalties the crime incurs, and what kinds of options are available to proceed. You know, to give him due process and equal protection under the law.
