Fark had a story from Florida a few years ago about a drunk guy in the back seat who leaned forward between the front seats, grabbed the wheel, and earned himself a lifetime license revocation.

Life lesson learned: don't drive drunk people home. They will wreck your car and puke on the floorboard.

/or make them ride in the back.

I have a big problem with this being treated the same as somebody who goes out drinking, knows he's drunk, and drives away. This should be charged under some other law.

Not defending the drunk person here, but I agree with you. DUI doesn't seem to be the proper charge here. There has got to be something along the lines of "interfering with driver operating a moving vehicle."

I was thinking reckless endangerment as well.

This is not the only way for a passenger to get a DWI in MN. If you are shatfaced and someone who is legally intoxicated drives you home in your car, both of you get a DWI. They claim you are in control of the car because you own it and can legally prevent anyone from driving it.

Really it is just a legal way for the state to get a 2fer.

I'd imagine that they could make a case for assault with a deadly weapon or attempted murder since it sounds like the woman deliberatly crashed the car.

Causing a car crash because you were drunk. Yeah, I also have no problem with the DUI charge. Grabbing the steering wheel isn't interfering, it's taking control and driving.

Agreed, though the penalty should be just as stiff. Even if I was smashed out of my mind I would never grab the wheel while someone was driving.

Two felony accounts? Are you kidding me?

Well, what is DUI? Driving under the influence of alcohol. She was doing that. Now, they may be right to tack on MORE charges for interferring with the driver, deliberately crashing. Those are separate crimes she committed, but she ALSO was drinking and driving.

If all she gets is DUI, I'd say she's actually lucky.

2011-11-30 05:47:44 PM
And? What did we learn here? Don't drive people who can't handle their alcohol around. She clocked in at around .21, which is pretty drunk, but not retard drunk. That starts at around .26 BAC. Regardless, it's a stupid move to let a drunk have shotgun; they'll fark with the A/C, radio, heat, and not give a damn.

You know what, never mind. What you said is what happened. Fark headline is inaccurate.

FTA:

Lenzi was charged by summons with two counts of felony criminal vehicular operation

No word on DUI at all.

Since she grabbed the wheel I guess I'm ok with this. Reading the headline I thought she was just a passenger which would have been asinine.

2011-11-30 05:55:07 PM
She should have three counts of attempted manslaughter.

Jerking the wheel into the farking median? The only reason I don't bump them to attempted murder charges is because this chick obviously knows how to party and I'm pretty alright with that.

/doesn't know if attempted manslaughter even exists
//but this would qualify if it did

The purpose of the law is to keep drunk assholes from killing people. This drunk asshole could've killed somebody. How is that different? Case closed.

Alcohol + Dumbass = DUI

When you grab the steering wheel you cease to be a passenger no matter which seat your in.

Can't they make up some magical law like "interfering with the driver of a motor vehicle" and "interfering with the driver of a motor vehicle while under the influence"? I mean seriously, are they going to charge a drunken three-year-old who happens to grab the wheel with a DUI? Come on!

Equally true story, I'm afraid.

if the FARK L.A.D.D brigade can't realize that this wasn't a case of poor judgement, this woman was likely passed out on her feet when she did this, then shame on you for claiming to be a farker. Not excusing what she did, but it isnt a crime, any more than sleepwalking is.

2011-11-30 07:56:31 PM
My main problem isn't the grabbing the wheel. I think it is bullshiat that you can publish that someone was arrested for underage drinking.

Oh you are too young to be responsible with the devil juice, but you are old enough for us to artificially punish you with something that will follow you for life because we want to protect adult minors.
