The church, in return, has asked a judge to dismiss the lawsuit, alleging in court filings that the condo owners are trying to violate the church's constitutional right to the free exercise of religion.

Freedom is religion is not a pass to do whatever you want. Laws, ordinances, etc still apply to you.

Live across the street from the local Apostolic Church. Those folks really get down with the drums and yelling and such. However, the church is set far back from the street & across a large parking lot, so I never really notice the noise unless I'm outside and it's otherwise quiet.

Would get rather annoying if it was something I could hear through the walls, though.

TFA seems to be leaving out quite a bit, but apparently a couple decades ago this church had a big building but almost no congregation. No congregation = no money to keep up the big building, and it was getting run down and icky. They sold a big chunk of the church building off for condos, but kept the sanctuary and a 99 year lease on the Sunday School classrooms. The condos were hugely popular and sold for way lot of money.

Twenty years pass, and the still-tiny congregation decides to become a satellite campus for a local megachurch. So instead of a couple dozen people and an acoustic guitar in the sanctuary on Sunday, you've got a renovated sanctuary with a full worship band (they did put in sound baffles to decrease the noise), and people actually exercising the lease on the Sunday School space.

Now the condo owners, who probably expected the church to go the way of the dodo, are seriously torqued about the new status quo, It's not a race thing, it's a "the church in the same building wiith me just grew twentyfold and won't get off my lawn" thing. Should be an interesting case, but I suspect the church will win most or all of it.

The church that was originally taking part was a smaller congregation and very low key. They had less then 100 members coming in on Sunday.

They sold the church to a megachurch with over 3,000 members.
There is a hell of a lot of difference.

It's more like moving some next to someplace with a house band with a cheap amp and they upgraded to a full 15000W concert style speaker system.

I grew up in a former church parsonage; the neighboring church thought nothing of blasting its sermons out over loudspeakers. If I wasn't born an atheist, witnessing such blatant disregard for the sensibilities of others surely had an impact.

I'd say there's a difference between music that can be toned down and typically occurs just in the morning and evenings on specific days, and an airport where the sounds of jet engines cannot be adjusted. People can stop singing so loudly, or the churchgoers could install insulation or better windows to cut the transfer of sound. And it does sound like the new non-denominational freaks started up in just the past year or so, after the condos were set up. But yeah, people should expect churches to be loud on Sundays and Wednesdays, schools to be noisy during school hours and Friday night football, airports to be loud 24/7, railroad crossings to be noisy when a train rolls by, etc etc.

I can't stand when people knowingly move in next to a place and start complaining about it, or worse, file lawsuits. We've had numerous stories on Fark about similar things - noise at airports, smells on farms or near mills, etc... If you want privacy and quiet, buy a house, not a condo. Would you be so anti-them if it was a bar playing music until 2 in the morning (like my ex-girlfriend's apartment)?
