I love how telemarketers are calling the first amendment on this, but hey, just cause you have the right to speak, doesnt mean i have to listen.

2003-10-07 07:35:36 PM
I used to get several telemarketer calls each evening. I've had one telemarketer call since October 1. Its nice being free again.

2003-10-07 07:35:52 PM

Hey, that's like 1 million pages of names! Someone's gotta pay for all that ink!

2003-10-07 07:39:31 PM
Well, isn't that nice? 51 million people sign up for the do-not-call list, and a judge is going to allow the list to be enforced.

I don't know ... but when 51 million people sign up for the exact same thing, wouldn't you consider that to be the will of the people???

A damned judge has to allow this?

2003-10-07 07:39:37 PM
how could these compaines say they would be losing profits from the people who do not want thier calls and hang up on them automatically........

I think it's great. Make some money off the side too.

2003-10-07 07:42:08 PM
Thus the death blow is delivered to the fark wad telemarketers.

2003-10-07 07:43:10 PM
I'm actually hoping one will call now. I plan to offer them the choice between sending me $5000 or being reported and having to pay $11000.

2003-10-07 07:44:30 PM
Doughnut call? here piggy piggy piggy......oh wait

i'm sorry

pig call.....doughnuts! free doughnuts!

BTW...very happy that i ahve not recieved any calls in the last few days!

2003-10-07 07:45:12 PM
Well, suppose it gets declared unconstitutional. I betcha those telemarketing firms are immediately going to target all the numbers on the list, out of retribution.

2003-10-07 07:48:08 PM
fark me to tears - there is a thing called the Constitution that needs to be addressed. You may hate the teles, but right to privacy vs. free speech rights - damn right I'm glad the judicial system is reviewing this issue. 50 million people may want to allow slavery again, but its unconstitutional

2003-10-07 07:50:03 PM
Fark Me To Tears....
A lot of people, probably more than 51 million, would like to rob a bank and get all the money in it, but that's illegal the last I heard.

I'm all for this list, I signed up for the one here in Colorado and it is WONDERFUL. However, I can partially see the legal argument for free speech by the telemarketer morons. I just hope the US Attorneys on the case can present a good case for the list to remain permanent.

And yes, the telemarketing firms must purchase the list. I do not know how much it is, though.

2003-10-07 07:50:15 PM
Fark Me To Tears - You are right.

I just wonder why telemarketing companies do not understand why people signed up for the list in the first place. Why fight it? We do not want your calls...

2003-10-07 07:50:30 PM
Do surveys count as telemarketing?

This one wench keeps calling asking me to take a survey about my satellite tv.

2003-10-07 07:51:11 PM
it's cut way back on the calls I used to get- there's still the issue of the bastard who calls at about 8, and
doesn't say anything. just silence on the other end.

2003-10-07 07:52:27 PM
Doesn't it save telemarketers the time to have the list of people who aren't going to buy anything anyway? I think it's more productive for them to only call people who would possibly buy their stuff!

2003-10-07 07:52:31 PM
Why not just put everyone on the list and let the ones who don't want to be on it call and say so?

2003-10-07 07:53:58 PM
Even in the unlikely even it's ruled unconstitutional, the telemarketers should look at it like this: How likely are they to make a sale to someone on this list? Pretty unlikely, no doubt.

2003-10-07 07:54:38 PM
...victory...

Yeah, this seems to be the latest. They can't call and they have the equipment, so they just hassle people. Telemarketers suck.

I have a message on machine right now where the telemarketer is saying that he's with a "non-profit credit reduction service" - bullshiat. As soon as it is possible, I'm reporting the sucker and hopefully we'll see him wiggle on the hook for a while, at least.

Re: the right to Free Speech:

You have the right to stand on your soapbox and say anything you damn well please. you should NOT have
the right to just call me at random and plug whatever it
is you're selling. If I want to hear what's coming out of
your mouth while you're up on the soapbox, by golly, I'll
come over to your soapbox and listen.

The Do Not Call list is more popular than both of the asshats who ran for president in 2000:

Bush: 50,456,062
Gore: 50,996,582
Do Not Call List: appx. 51,000,000

2003-10-07 07:57:06 PM
if this is true....how the hell do I fix my rock chip on my windshield?

2003-10-07 07:58:15 PM
no calls at home but tons and tons at work....so my guess is 'if you wanna keep your job you best be callin' the companies instead.....'

Are you aware that the USC places a distinction on "Free Speech" which is protected and loosely regulated, and "Commercial Speech" which is heavily regulated and not so strongly protected?

If you haven't caught this bit of law yet, look into it. Food for thought.

I'm excited.

Now I am no lawyer,
But does 'Free speech" apply to a cooporation?
Seems like it would only apply to individuals since the bill of rights defines individual rights.
If not we should look into making it that way...

Corporations have all the legal rights of individuals. No joke.

Congrats to the people who are on the national DNC list. I am already on the Mass one that went into effect on April 1st. I got a shiat load of calls the last week in march, then when April 1st came, silence, it's pure bliss. :D

I still don't understand why the telemarketing companies made a big deal out of this. There have been laws on the books for some time stating that if someone requests that thier name be taken off of thier call lists, they are supposed to remove them. However, the telemarketing compaines choose to ignore those requests. I know that I made numerous requuests that were never honored. The DNC list just defines in black and white which numbers the telemarketing companies are not supposed to call. They are just biatching beacuse it is now, finally, being enforced.

*major applause! Victory for the people who want the privacy of thier homes being returned back to them!

I used to have metered service on my phone back in the 80's. Supercheap, like $10 a month and 60mins of calls. But, if you went over 60mins it was like 5 cents/min.

If a telemarketer called me it would cost me money--they don't have that right anymore than calling a cell phone or fax machine. I think some areas of the country still offer this.

If you're thinking of droping your land line, but want to keep the number--ask them about metered service, even the 80's it wasn't something they advertised unless you asked.

2003-10-07 08:11:00 PM
Yeah, commercial speech is already limited so that you're forced to present certain business information accurately, for example.

2003-10-07 08:12:03 PM
But.. If telemarketers don't call me then who would I talk to?

I'm so lonely...

2003-10-07 08:12:13 PM
I've had only a mobile phone for the past 3 years. It's nice to be reasonably confident that when your phone rings it'll be from someone you actually know instead of some asshat trying to sell you something.
