Simple assault, with as many charges as people who can demonstrate they got sprayed.

I know that when I'm stuck in a crush of people and about to be trampled to death, I reach into my purse, grab my mace, spray the crowd, and then quickly recover enough to grab my purchase & proceed to the registers. Getting the hell out of the way of a crazed Walmart mob never crosses my mind.

This is a slippery slope. The "fear for my life" defense can go too far. Step too close behind me and all I have to say is "I fear for my life" before I Taze you or pepper spray you. Recent story in my home town: a driver shot another driver in the neck because he thought the other guy had a gun. No gun. No charges filed yet.

It's unlikely she will get sued as even if you get a judgment in your favor how do you collect? No deep pocket. They will sue Walmart ... maybe she will be named in the suit but chances are she's a broke ass biatch.

Not that the item this was over would ever justify the use of paper spray in a case like this, but the fact this was over a 5 year old video game console worth a few hundred bucks just boggles the mind.

Well it seems to me that her self-defense argument should be thrown out due to the fact that she then proceeded to go to the checkout and make her purchases and then quietly slip out of the store. It seems to me if she felt threatened enough to use mace to defend herself, then it would be expected that she would at least vacate the the premises as quickly as possible (you know, not standing in line waiting to get checked out) for her own safety, if not report the alleged actions which resulted in her feeling the need to use mace to the police, or at least the store management. She could be charged, they just don't feel like it.

A big business won't go to the trouble of running down a non-rich person, but if you don't mind jumping through hoops you can still effectively punnish someone financially. My wife (an attorney) will do this from time to time. It helps because it makes people realize she means business. She has even gotten debts PAST a bankruptcy and gotten in front of primary mortgage note holders on foreclosures (I am an accountant and I don't know how she does that). Also, many idiots will end up with contempt charges and get locked up (with their bond set to match their debt). You would be amazed how much money can appear from non-well-to-do families.
