It's this kind of kindergarten shiat that's why there are more lawyers in law school than practicing lawyers working now. I'd feel embarrassed waking up and putting on a tie to argue this sort of horseshiat.

Chick-fil-A spokesman Don Perry said the company does not comment on pending legal matters.

ESPECIALLY when faced with someone who won't cower in a corner when some ambulance chaser sends a letter. IMHO, Chick-fil-A is inedible anyhow.

This is probably overkill, as "eat more ____" is likely too generic to really cause confusion with the "Eat Mor Chikin" mark that contains intentional misspellings in connection with cows that are supposedly spreading that message.

That is true, and it explains a lot of this nonsense. However, I think that means that the law, itself, is messed up when it actively encourages these kinds of letters and litigation.

What a bunch of dicks!

I've never understood the attraction to Chick-fil-A. I tried one way back when they were just kiosks in the malls and my impression was: meh,boring. Then I stopped in with a friend a few years back and thought I'd puke. The actually infuse their chicken with chicken flavoring these days. It tasted like chemicals and smelled like ass.

And, even if you love Chick-fil-A, you can't get one on Sunday because it's a sin to be open on Sunday. Of course the Cathy brothers are just waiting for the old man to kick, so they can start opening on Sunday.

normally i can let an OPINION (for OR against something) go, especially when it involves fast food menu items...and i'm perfectly able to let someone go for saying they just prefer not to eat at CFA, but "inedible"? seriously? it is quite possibly the highest quality, freshest, and dare i say healthiest fast food there is!

please, say it just doesn't suit your tastes...please say you don't like their religious views...please, just don't leave it at "inedible"!

There are roughly 140,000 people in law school right now. According to the ABA there are about 1.2 million active attorneys.

So unless 85% of active attorneys are not practicing law (which is almost assuredly not the case as most non-practicing attorneys do not stay current), there are nowhere near as many law students than practicing lawyers working right now.

"Got Milk?" is basically public domain because it was never defended. "Eat More _____" could easily go the same route.

They should've coordinated their efforts. Seriously, we have a (somewhat) local company that does a version of the "most interesting man in the world" campaign. When another local company did another super-low budget spoof on the "most interesting man" campaign and brought in the guy from the first local company, the commercial went viral (locally) and has probably been seen online by more people than any of their other very strange low budget commercials have been seen online or off.

i ALWAYS get that craving on a sunday. even been at the drive-thru speaker, on the phone with my wife taking her order, wondering why in the f**k it's taking so long to get them to ask what i want, when i look up and realize the lot is empty, the lights are off inside, and oh geez it's sunday! no joke, that has happened TWICE!

my daughter just had her birthday party saturday...on top of all the other gifts and money she got, she also got $40 in cfa gift cards...that girl LOVES cfa! cfa and braums is about all she ever asks for when we're trying to decide on where to eat. i foresee a lot of bugging me to take her to cfa now.

There needs to be a better way to defend grey area matters like this one. The cease and desist letter just confuses small time business people (like the guy in the article, anyone in this thread describing this as a "lawsuit"). Plus, it is not in the public domain, so nobody else knows you are defending your trademark. I would like some sort of national registry where a trademark owner can basically put people "on notice" - have it count as defending your mark, but don't actually require the potential infringer to desist unless they raise to a more likelihood of confusion.

I like kale, it's pretty tasty when seasoned right. I like Chik-Fil-A, again on occasion it's pretty tasty. I don't like this lawsuit, and I really don't see how Eat More Kale can be confused with eat mor chikin' as the cows are wont to spel.

Just another lawyer trying to justify his/her position. He/she was probably faced with termination if he/she didn't find some thing to get his/her panties in a twist about.
