So ICE is now our mommy? Seriously, if you're too stupid to be online, stay off.

I hate the idea of anyone censoring the internet. It's designed to route around damage, which is what censorship is.

Hell, at least it's still ICE doing this. Just a matter of time before we delegate all that authority straight to the MPAA and friends.

You have it backwards. It was the MPAA that delegated it to ICE so taxpayers would pay to preserve their outdated business model.

I don't care what the name is as long as it comes in one of those plastic cabinets that prevent fall apart

I wonder how many of those sites that were seized by the US were not even registered in the US

2011-11-28 12:15:55 PM
Innocent, non-troll question:

How can the US government simply seize domains? What if they're hosted in other countries?

2011-11-28 12:24:11 PM
How do I get in on this business? Is there some web-form where you can enter domains you would like to shut down or do I have to email someone. I expect there won't be any actual review of the sites content or even a proper trial because seizing domain names is obviously not a 4th amendment issue even if they are the core of someones business. I really would like to shut down some websites and I could even come up with some sort stupid justification for shutting them down, It's not like the evidence has to stand up in court.

I'm quite surprised Alibaba.com is still in operation, since it's basically a one-stop clearinghouse for Chinese knockoffs.

From TFA:

While many of the newly grabbed addresses are registered to individuals in China, all 131 are in the .com and .net zones, both of which are managed by VeriSign, a US-based company.

Well, half of my Xmas shopping is coming from China this year. Living in Sweden, I couldn't care less what ICE does in support of their corporate masters. I'm not buying the brand, I'm buying the cheap consumer good.

2011-11-28 01:14:05 PM
Oops! Here's the rest:

ICE has previously stated that all .com domains fall under its jurisdiction, regardless of where the owner is based, due to the location of the registry. VeriSign has said that it cooperates with the seizures when it receives a court order.

Actually, there is review, and they are considered property. You can file takedown notices, but if it's shown that you did it maliciously or without good faith, you could end up owing a lot of money and spending time in prison.

Cajnik: I wonder how many of those sites that were seized by the US were not even registered in the US

In this case it doesn't matter since the TLD they got the delegation in is in the US (net and com). The IP holder/ICE can to to the registry (here, Verisign Inc) with a legal notice and get the delegation changed to point to the parked "seized" page.

SOPA/PROTECT IP changes that to put the burden on the ISP to redirect users instead of going to the registry or registrar. That is because US law enforcement can't force a country code to do something that isn't part of that country's laws.

Dammit!

I was about to by a Canyonero off one of those sites.

Funny thing, whilst I support them shutting down such things I actually have no problem ith the goods themselves.

So long as you aren't selling them AS the real thing.

Sorry, but that's bollocks; "Could" is not the same as "Will" or even "Might".

I run a forum with a little over 30k members. In the past, we've had a former, banned member file a false DMCA takedown notice and successfully get us taken down; We owned our hosting, which is in Germany, but not our DNS. As I've said previously on this subject, 1and1 didn't even investigate or give us proper notification, they just took us down. We have since switched to GoDaddy, who actually do follow the damned procedure, and they now just ignore the repeated attempts by that same member to have us taken down because they know it's malicious and meritless.

The banned member who got us taken down faced zero consequences, and no action could be taken against them, because they were Australian.

SOPA must not pass; it will break pretty much every site with user generated content.

I just bought me a great Panasoanic tv on Black Friday (not).

Last time I went to Brownsville to work for a week, I saw a store filled with high quality Panasoanic electronic goods..............

I'm thinking more along the lines of, is this really the US govt's problem?

Cajnik:

It is the problem of people who are paying politicians to have the US gov solve it.

Or do you really think that it is in the interest of the general public to see government resource be wasted and free speech be trampled on what is essentially a dispute between private parties?

If the makers of designer handbags feel their profits threatened by cheap Chinese knockoffs (as oppose to the genuine stuff that is also made in China) they should sue them themselves and not try to get the US gov to do their dirty work for them for free.

(Very simple explanation that nobody asked for)

Imagine a huge neighborhood designed by the most ADD person around. The house numbers are all over the place and in no real order. The only way to find out where you want to go is to consult the guy at the gate of the neighborhood. He'll give you directions to the place you want.

All the government is doing is taking that guy's registry and deleting (redirecting) that entry so you can't find what you want.

That doesn't take away the ability for that person at "fakehandbags.com", physically located in China, to start giving out their direct IP address to be entered, though, because the physical location is still there; it's just that someone erased it from the map.

The one I always remember from my childhood was "Panasoniac". Saw that one in two different stores while shopping for TVs back in like 1987 with my father. Perfect font, and otherwise the television and box looked exactly right. A few months later, we saw an investigative special that called out this counterfeit by name (60 Minutes, or one of the similar report shows).

I for one am thankful that these scumbags are off the street, I mean out government could be out there wasting money cracking down on frivolous things like terrorism and other violent crimes. Instead its great to see that our money is being used to pay for this.

The registrars for .com, .net, and .org are US-based.

If it's based on the registrars, just use the ip address
