So much for that "speedy trial" thing. Is it that hard to get a hearing?

I see (said the blind man).

How are they to know that he's deaf??

He can't read, can't write, and can't read lips. He has no way of communicating to them, and they have no way of communicating to him.

He probably just looked like a huge asshole who wanted to stonewall them.

Yeah, we get it. You're deaf. You still need to learn English, you farktard.

To bad the guy couldn't speak Mexican. Plenty o' interpreters standing by for that, ala our taxpayer's dime.

It seems odd that he doesn't know how to read or write, but at the same time it's not hard to figure out that someone is deaf.

I just don't buy the whole "can't read or write English". Can't read lips, that's plausible, since it can be very difficult, but I can't imagine that he can use the internet, use ASL, and not know how to write a few words to the cops. I think he WAS stonewalling them because he was mad about how he was arrested, and knew that he could nail them on the ADA. This is a lot of fail all around.

He would likely have attempted sign language.

The fact that his wife also tried to communicate to them with sign language, according to the article, ought to have been a clue as well.

---

Not defending him not being able to read or write. That would personally be on my "to-do" list if I were deaf, but whatever.

Just so you know, I'm an interpreter for Spanish speakers in the county where I live, and I'm a volunteer. None of your tax dollars are going into my pocket. I wish I could say the same for the perpetrators of tax fraud and benefits fraud that I have seen. There's a lot of our money going down the drain there....

Obviously, he wanted it to be as difficult as possible for a non-deaf person to communicate with him.

Can't read or write English, but speaks ASL? I call shenanigans; part of ASL is the signed alphabet.

I bet he did not see that coming.

Just because he can sign the alphabet doesn't mean he can read it. Hell, maybe he can't even sign it. A version of deaf illiteracy, where he can sign words but not spell them. I dunno. Though how a deaf man can go through life never having learned to read/write is sad and strange. However, that the county never brought in someone fluent in ASL is ridiculous. Whatever they were thinking, you'd imagine that after 3 days they'd want to at least explore that obvious idea.

It might be really heavy on the bass. Deaf people can still feel it in their bones.

Rappers with their gangsta hand signs may well have desensitized cops to sign language.

/Also, the middle finger might not be the best approach.

I agree that it should not have taken 25 days to obtain an enterpreter, it shouldn't have taken nearly that long. I would like more information on how cooperative he was attempting to be while in custody (did he sit there with his arms folded, or did he try to initiate communication through sign?), but once it was known what kind of enterpreter he needed, I can't see why that would have taken more than 3 days, tops.

I do feel that any adult should be able to read and write- heck, if he could read and write in swahili or mandarin or something, the cops could've used google translate to at least open a dialoge

Another question IMHO is why they didn't just release him.

Because they couldn't establish identity, he had no papers on him? Surely grunting in a motel room doesn´t warrant a 25 day jail term.

My guess is he pissed them off and his attempts to use sign language were misconstrued as aggression, or some such police horsesh*t.
Also, failure to comply by not answering the door of the motel - because he was farking DEAF and didn't hear it.

So you retaliate for 25 farking days?

According to the lawsuit, [the fiancee] tried to tell the deputies that Siaki didn't hurt her but couldn't because she was not provided an interpreter or any aids. (new window)

Even the finacee, who CAN communicate, said the cops didn't do anything?

Any wise-ass answers to that, Cupcake?

Deaf people have no idea how loud they are when they verbalize. The stepdad of a friend of mine was deaf and I was at their house when he was shouting at my friend while signing. I thought my friend was in trouble and he said, "No, he's just excited to meet new people and wants you to stay for dinner."

On a side note, how the fark could you possibly communicate with a deaf person using ASL alphabet signing who is dyslexic? What if both of you are dyslexic? Would that work?

2011-11-28 08:25:51 AM
The article says he can't read or write English. The guy is Samoan from New Zealand. Perhaps he can read/write Polynesian instead?

Nothing excuses a 25 day time to get an AmSLan interpreter in. It's not that uncommon and they had some evidence that he might be deaf from the fiancee (who they didn't tackle after breaking down the door) who tried to tell them.

2011-11-28 08:26:01 AM
What is a fiancDee? I haven't heard that ONE before. Maybe writing a story about deaf people impairs your writing ability?

2011-11-28 08:27:13 AM
As far as the mixtape goes I had a girlfriend years ago who was 100% deaf yet could "hear" music by lightly biting down on the speaker housing, I play the mandolin and she used to sit next to me with the arm of my capo in her teeth (ya ya get the laughs over with) so she could listen to me play.

/she died of cancer about 10 years ago, I still have that capo with her teeth marks on it.
