Yes, they should be. In fact, breastfeeding mothers in Oregon are exempt from jury duty so long as they request to be excused in writing. This is generally done on the jury summons form you receive in the mail.

Look, if you wanna treat pregnant wimmins and mothers differently, then put it in the constitution.

Just like sex offenders, change the constitution to put them in jail for life instead of these "legal" loopholes that prevent them from living within 2000 ft of a park or school, despite the fact that they rape grandmas.

Well...you have to admit that they are less likely to menstruate all over the jury instructions, since lactation often inhibits that activity.

As the woman in the article stated, there are issues with being given the opportunity to pump the breastmilk while on a jury, and there isn't anywhere she can safely store the breastmilk while she's on jury duty.

I just did a stint on jury duty (didn't actually sit on a jury, though), and the rule in Texas is that people for whom jury service would be a hardship MAY serve if they want but may also opt out. Included in that list are primary caregivers for very small children, which a nursing mother would certainly be. Again, they're not on the you-can't-legally-serve-on-a-jury list, but they have the option to say no

Hot-button issue? The online poll is currently 77% in favor of exempting them to 22% against.

Unless that 22% starts claiming they're 99%, and then start raping and murdering people who disagree with them, that's not much of a hot-button issue.

As a woman, I am deeply offended that any woman should have a valid gender-based excuse to not have to serve like the rest of us.

As a human, I would rather not have a baby in the jury room, and especially not if we're sequestered for any length of time, thanks very much.

I actually was called to serve jury duty while I was nursing. I said I would love to but I would need to bring my son in to nurse. They said no, their decision not mine.

Honestly, it's a pain in the ass to the court system so why distract from the duty by having some women whip it out. Some people still find it offensive.

Of course they should...why waste this bandwidth. It's a temporary "problem". Just like if a relative died...etc.

When I went to Jury Duty selection, it was painfully obvious by letting everyone watch that once the potential jurors saw that it only took for someone to say "X", that was the choice for getting out for so many others.

Seriously, though, this is a stupid question. No woman should be on a jury. There isn't a movie called 12 Angry Women because the phrase is redundant once they start menstruating at the same time.

When my mother was in her third trimester carrying me (mid 1980s), she was prosecuting a case. The defense tried to have her removed as her pregnancy would unfairly prejudice the jury in favor of the state. The defense lost the motion and the case. I still have a clipping of the article somewhere.

I'm just amazed that in a Fark full of people who whine constantly about babies on a plane, NOBODY has yet noticed the potential horror of babies in a jury box. Who cares if there are nursing moms on the jury; but if there's a nursing mom there, it means there's a NURSING BABY along with her, and we all know what babies do: CRY.

Wait, are babies actually *allowed* in a courtroom? I would think that a baby would be deemed too distracting, and would have to be cared for by a relative or something. Not trying to troll, it just never crossed my mind that anyone would want a baby present while court is in session.

And you can't keep stopping the court.

So this isn't really about breastfeeding, or breastfeeding rights, It's purely practical, and legal, reasons.

I have no problems giving more "outs" to people who would experience hardship. Is there a lack of jury candidates or something? I've never been called up. I'd take her place on a jury.

Um... what the hell are you going on about? I dare say it's reasonable to exempt/delay the jury duty of a pregnant woman or nursing mother.

Last time I had jury duty, one of the big questions asked was "Are you the sole caretaker of a young child?" In other words, if you were going to be worrying about your kid all day, they were likely to dismiss you post-haste.

/interesting experience, I made it all the way to voir dire. Three college degrees = no way either side's lawyers wanted me.

No one should be FORCED to be on a jury. Anyone should be able to get out of jury duty simply by saying " I dont feel like serving on a jury" Instant release should follow.

FORCING someone to sit on a jury isnt going to be fair to one side or the other. Someone pissed off just to be there isnt what we need in the box.
