agents operate in a secretive judicial environment where detention hearings are held out of public view.

time to demand that these hearings and ALL other hearings be held in public. period.

or stop calling ourselves a free country

fta A recent study at Northwestern University found thousands of cases in which U.S. citizens were arrested in error and held for deportation.

Would I get to pick the place to where I'd be deported? I wouldn't mind a little visit to Portugal on Uncle Sam's dime while they sort things out.

2011-11-27 01:54:00 PM
But FBI records available at the time of Clarke's immigration arrest in 2008 clearly show him to be a U.S. citizen, and documents in his immigration file show that immigration agents were aware of his status the day he was taken into custody.

arrest them for false arrest and kidnapping. hold them without a lawyer for 300 days.
brand them with a giant A on their foreheads. ban them from suing in any court.
(they are immune from prosecution, right??)

bwahahahahahahahaha

Hmmm. Arrested in an illegal entered residence. Held even though officers knew he was innocent. Moved across a border and denied contact with family and probably a lawyer.

This guy's lucky he only ended up in South Dakota. Usually that story lands someone in a Romanian prison with some guy latching a car battery to your nads.

What's FUNNY about this story is that when the patriot act was signed and they made homeland security, people complained that once we started treating illegals this way, that it was only a matter of time before we started treating citizens this way.

TADA
we officially live in a police state.

/would be awesome if the federal judge found the government agents to be in contempt of court and held them for a year.

Considering the guy in TFA was born in Jamaica, I'd say that's where they were planning on deporting them to. Certainly wouldn't be a bad place to move.

2011-11-27 02:15:24 PM
This isn't new. There was a story from a few years back where the locals authorities arrested a US citizen of Mexican descent who happened to be a schizophrenic. The authorities gave him to immigration and customs who deported him, despite the fact that he was born in the US and doesn't speak Spanish well, to Mexico, where he was essentially left to wander. His family in the US couldn't even find him until several months later, when he was discovered living homeless, completely out of his mind, and in his own filth.

Good job, ICE.

FTA: Federal agents arrested Anthony A. Clarke during a late-night raid in 2008 at his sister's house in Columbia Heights, then shuttled him back and forth between a Sherburne County jail and an unidentified detention facility in South Dakota, the suit says.

Finally, in late 2009, a U.S. immigration judge in Bloomington ordered Clarke's case closed after government attorneys concluded themselves that Clarke was, indeed, a U.S. citizen all along.

/Clearly this is all Obama's fault.

Maybe you should RTFA.

FTA...After a detailed examination of federal immigration records, Prof. Jacqueline Stevens of Northwestern University estimated this year that about 4,000 American citizens were illegally detained or deported as aliens in 2010. In a study published last summer, she found that as many as 20,000 citizens may have been wrongly held or deported since 2003.

You can't put all the blame on the current administration. And the man who was arrested and threatened with deportation in the article? He was arrested in 2008. Who was President then?

In 2004, alleging that Clarke was not a citizen and had committed a drug offense and an unidentified felony, agents built their case for deportation. In January 2005, Immigration Judge Kristin Olmanson, acting on that information, ordered Clarke deported

This is a very important point buried in the middle of the article.

Obama had been secretly micro-managing the Federal government for at least two years before he was "elected" president. He deserves the blame for every single thing done by anyone working in the Federal government (well, except for the Navy SEALs).

Buried? Puh-leez. You neglect the sentence that follows it: But FBI records available at the time of Clarke's immigration arrest in 2008 clearly show him to be a U.S. citizen, and documents in his immigration file show that immigration agents were aware of his status the day he was taken into custody.

...And you;'re ignoring that he had been a citizen since the 1970s.

The article makes a valid case (maybe not sound, but valid nonetheless), that the problem with the deportation process is bigger than merely Judge Olmanson.
