Your quibble is the lack of a declared state of civil unrest? Must that declaration come the mayor or the governor? Are police barricades necessary? One could argue that group of people breaking into a closed store and removing the merchandise might qualify as a state of civil unrest, as that sort of thing is generally frowned upon by the authorities. My premise is not what the perpetrators might be charged with, rather the characterization of the theft in the media. Were this a store in Harlem, I imagine the tenor of the story might include the word "looting". Because this was store the affluent neighborhood of Soho, the word burglary was used.
